hi guys,

just a bit of background:

She - USC Petitioner

He - Beneficiary

I'm getting ready to file for AOS. we got married but she still hasn't filed a formal request to change her last name to mine with SSN, work, bank etc..we now have the certified copy of marriage cert..

should we use her "single" last name or her now married last name when completing the forms?

Your marriage certificate is the official document that USCIS will accept as proof of name change from maiden to married. You can submit AOS in married name regardless of the other documents.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

You can put either. What name the USC sponsor uses on the forms is not as important as the name of the immigrant. Their cards will come in whatever name is used on the forms, so it is more important for a female immigrant to list the name she wants to use from now on.

I had not officially and legally changed over my name to my husband's when he filed for his AOS so I did not put his last name as mine on the forms. I have since changed everything over to his name, so when time comes to file ROC, I will put my married legal name on the forms at that time.

If she's electing to take your married name then married name, regardless of changing all those other documents over. Honestly though USCIS doesn't care too much as she's not the immigrant.

Also, when sending the I-485 and I-765, I noticed that they have similarities when it comes to the required documentation such as 2 2x2 passport photo, copy of passport, I-94 card, photo copy of K1 visa etc...should I send one set of document for each of the form or just one set of documents for all the forms which is I-485, I-765?

Send one set with each form. Think of them as separate, but being mailed together to the same place.

also, my USC fiancee meets the 125% income requirement from her employment. I will include her 2011 1040 and employment letter as well. would it be best even if she does meet to do the following:

1.) file current bank statement under Other assets (I 864 says this is not required or that this is optional)

2.) file sample earnings statements

3.) include 2010 and 2009 1040's which is also indicated as optional in the form?

I am hoping she is your now your wife and not your fiancee if you are filing AOS.

Standard practice is to send the most recent tax transcript, letter from employer and a few months worth of the most recent pay stubs. She does not have to send 2009 and 2010, but needs to enter the income amounts from them on the I-864.

You cannot send just the 1040 form by itself though. You can either get a tax transcript free from the IRS, or you can make a complete copy of what was sent to the IRS; the 1040, any schedules and attachments and all W-2s and/or 1099s.
