so my husband is in canada and he has us visa, i am us citizen. if he wants to come and live with me in the USA, can he come with the visa he has and stay? and how will i go by making him legal with a GC to stay?

What kind of visa does he have?

oh i don't know exactly the category of the visa but i know it was for 5 years, and it will be expirer february 2013. and i'd like to petition for him to stay here before it expirer.

The proper procedure is to petition for him by submitting an I-130

i was thinking the same thing but will he be able to stay here with me while it pending?

i know it illegal, that is why i ask, if while the case is pending, he could come? anyway thanks for you are input, it is not our intention to come here illegal. i just misunderstood the whole adjustment status process. i was thinking it was for anyone with a US visa and applying to change their status to having a GC and they still get to stay here ( of course with USCIS knowing them are here)while their case is pending.

When you file a I-129F for him (K1 visa when he is over there), his current visa might be revoked at the border when he tries to get into the US. He definitively can try another tourist visa, but when he has intention to immigrate, the chance to get another one is slim, but possible. Just don't ever tell anyone "He will travel to US on tourist visa then we will adjust status here, so he doesn't have to go back." because it is visa fraud.

He's a husband, so it would be a CR-1 or IR-1, not a fiance visa. He can probably keep using his tourist visa to visit, but should bring ties to Canada/ proof he will return, and will need to be in Canada for the medical and interview.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
