A search on this site will find dozens of threads about exactly this. File form W-7 with the tax returns (mail only, no e-file) and attach required documentation. The instructions explain more.

The good news is that Austin is turning out ITIN's pretty quickly. We got ours last week and filed in mid-February - about 20 days from filing to receipt.

@marissa take the time to read this post - its fairly new - and up to date - take note of all the posts in it - including the option of taking your original documents along with w-7 and completed return to the local tax office - they will verify and copy your documents and then give the orignals back to you and send all this for you...

what did you use to compile your return? software or a tax professional?

if you used turbotax (offline or download) were you able to leave your spouses's ssn blank and print?

or if you used an online version - same question - were you able to print a blank for that ssn?

I used Turbotax online (some paid version, don't remember which one) and it let me leave my wife's SSN field blank. It'll ask you multiple times to correct the blank field but will allow you to print it without issue. I then printed it out and mailed it along with a notarized copy of my wife's passport to the ITIN department in Austin. They'll fill in the SSN field with her ITIN and file it with the IRS (hopefully this week).

I also printed out my state return at the same time and left the SSN field blank. When I received her ITIN last week I filled in the SSN field and sent that off. Pretty easy.

Here's a much shorter thread that will answer your question also.

That's good to know. I sent mine off the beginning of February and i still haven't received anything. Maybe this week.

I click the link on post 2 and read the W7 instructions. So if I don't want to send notarized passport, it seems I can just submit an ID (with photo) and birth certificate of my spouse overseas. Now do they have to be notarized and translated too? I have translated civil birth certificate, but not the ID card (hopefully it's dual language, but I doubt it). And do they have to original, or copies are okay?

im sure they will need to be translated/notarized.

My recommendation to you - if you can go to your local tax office with your original documents, they will verify them (for being "original") and then make a copy - that way you dont have to notarize.

They will then take your completed return and w-7 and send it all off for you...

Thats what my local Houston area IRS tax office offered to me.

okay. Hmm maybe I just amend it later when she comes over. I'll just file married separate. Then I just enter her income when I amend it later.
