I am SO STRESSED with the ROC application process. I need to travel abroad twice this year and am worried it will interfere with my ROC application. My 2 yr anniversary of entering the States is July 28, 2012. 90 days prior to this date is April 30, 2012. I will be going abroad from April 27th to May 8th, so I won't be able to send my application before I go abroad. I will be sending my application as follows:

-April 27 - May 8 traveling outside of America

-send application by Fedex on May 9th

-2 yr anniversary on july 28,2012

- travel abroad from July 27 to August 15th, 2012

Will this be enough time to receive my NOA1 and then get my letter to get my biometrics appointment AND do my biometrics appointment before July 27th?

Also, if I get my NOA1 letter, is this enough for me to travel abroad? ( and prior to doing my biometrics?) if I receive my biometrics appointment before I travel on July 27th and realize the date is while I am away, can I STILL travel abroad and delay the biometrics for after the 15th of August?

Finally my passport expires in Oct 2012. Can I still travel internationally up until September 2012?

Any help would be greatly appreciated!

Did you enter US as a Permanent resident?When does your Green Card expire?Your elligibility for ROC is based on your Green Card expiration date, not based on the date you entered US.

I believe the OP came on a CR-1 so those dates would match.

OP, your timeline seems doable to me but how quickly your biometrics appointment will come depends on how quickly your local office is working. If you receive your biometrics and it is while you are away, I would attempt an early walk-in first and if that is unsuccessful, then reschedule. The only issue (unlikely) is if you don't receive the appointment at all before you leave. Make sure, no matter what, that you have someone checking the mail while you are abroad.

The original NOA will serve as an extension to let you travel. Your passport will be fine to return to the US but you should check the requirements of where you are traveling. Some countries require 6 months validity left on your passport.

I entered the US with the CR1 visa. My green card expires July 28, 2012. That is two years from the time I entered the country. I know this is the time that I need to lift my conditions but am worried that my time abroad may interfere with all the deadlines...thoughts?

I am guessing though, that the biometrics would arrive about 1 month after I send in my doc? I understand that it depends on how fast the Vermont Service Center is working, but if I apply on the 9th, and at the latest, I get my NOA letter on the 20th of May, if I still get a biometrics letter on July 20th (two months after), that still give me 8 days to go to the service center to try to go early for the biometrics, or at least reschedule. Do you think the biometrics could really arrive more than 2 months later? What have all of your timelines been like?

Are people definitely able to reschedule biometrics as long as the date does not pass?

What you should do is look up all the ROC folks with the location where you're at and see when they get biometrics.

9/17: NOA

10/7: Text from USCIS on status update: Biometrics in the mail

The ROC NOA arrives about 2 weeks after receipt of ROC application, the biometric is about a week later. The bio-metric date maybe a problem,but if your center allows walk-in then you should attempt to proceed to do an early walk-in. Do not leave or try to enter the country without the NOA and a completed biometric if the GC has expired.

Any personal opinions? Do my dates look doable?

Have a look at the filers threads for ROC - The Vermont lists should give you a slight est on the biometrics times. You cant hope that you can rebook and get the 15th of August for your biometrics date because they give you whatever is available... sometimes its a very short time between the first appointment and the next one.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Your filing date opens April 29, 2012. My suggestion is to mail it before you travel on Apr 27 and use 2-3 days delivery, which will be delivered Mon, Apr 30th. If on that day Apr 27, you will be too busy to mail it, then maybe you can pack it up and have a relative or a friend mail it for you.

If you do this, it means you will have the NOA1 around May 7-10th, and you will have plenty of time for biometrics before your trip in July.

I believe that the date USCIS checks to determine whether the application is timely is the day on which the form is sent, not when it is received. If they mail the ROC package before the first day of the 90-day window, it will be rejected regardless of when it is received. In fact, they would need to date the documents as of the day of mailing (before the 90-day window). That would not be accepted. Since the conditional GC will not expire until the end of July, I would send the ROC package upon returning from the first travel. Assuming that everything goes well (no rejection, right fees paid, etc.), this would give them enough time to receive both the NOA (which extends the validity of the GC) and the biometrics letter before they leave for the July travel. As to the passport expiring soon, I would start looking into what to do to apply for a new one.

The time you have to wait for biometrics depends on your local office that does the biometrics. My wait was among the longest: two months after I submitted my application. I received the appointment letter over three weeks before the appointment. It was too far away for me to attempt a walk-in as they did not officially do walk-ins and I was under the impression that they were very busy. But when I got there they were totally UNbusy and said that they do do walk-ins, unofficially.

Going by the time-lines I've seen recently, I would expect you to be ok.

I suggest that you complete the I-751 prior to your first trip abroad. Give the package to a trusted relative or friend to mail on or about April 30. If your window eligibility opens on the 30th, they can receive it from that date onward. I agree that mailing it on April 26th would probably result in them returning it, but why not get it out as soon as possible i.e. prior to your return. If your "relative" mails it April 29th and they receive it the 30th or May 1st, you will likely receive NOA1 by the time you return May 9th. That would give you more than two months to receive the Bio letter, which generally arrives between 3 to 6 weeks subsequent to NOA1. As you suggested, you could either attempt an early walk-in or reschedule at that point.

I do not believe you have anything to stress over and that your present preparations are adequate.

For some reason I thought that I couldn't travel abroad once sending my application? I think asking a relative to send the doc is a good idea... I can definitely leave the country after sending in my application? I don't have to wait within America to receive my NOA 1?

Also, how do I look up past ROC timelines for my processing office?
