Hey VJs,

I am a little stuck on this and hoping to get some guidance. I am getting all the support documents for AOS for my wife and need the most recent year tax return. Now I haven't filled my 2011 taxes yet so I have only 2010 tax data available. The problem is that I filled my taxes electronically and thus do not have a copy that was signed. All I have is a pdf for my own records that the tax software saved on my computer. So, is it going to be a problem if I just print and attach it to the AOS packed or do I need to sign it?

As I explained in one of my earlier posts (http://www.visajourney.com/forums/topic/346794-filling-aos-after-visa-expired/page__p__5185585__fromsearch__1#entry5185585), my wife's visa expired a while ago so we are filling very late. I just don't any serious problems to pop that I could have solved easily before sending the paperwork.

First, your wife's K-1 visa was null and void the moment she used it to enter the US. It is a one time entry visa. The expiration date on it was for how long she had to use it to enter the US. The I-94 she received at her POE is the form and expiration date that became important after that.

Get a tax transcript free from the IRS. It will be all you need. No need to send in all the forms, schedules and W-2s. You will only need to send a copy of the tax return transcript you receive from the IRS.

Your wife's visa expired at the POE the day she arrived in the USA--the K-1 visa is a single entry visa and is not valid once it is used. The expiration date on it is like any other visa issued--you must enter the USA before that expiration date.

For your tax returns go here and order a tax trascript. This is preferred as it is what you actually filed with the IRS and you do not need the W-2s, 1099s and other supporting documents. It takes a few days--like 5-10--if you are in a real hurry, you can go to the local IRS office and get them printed out for you or you can call and have them faxed to you. Very easy to do.

Your wife's status in the USA is now based on her I-94. If that has expired and you have not filed for AOS, she is out of status, but that is not a problem if you martried within the 90 period per the K-1 visa requirement. Should she find herself near the southern boarder, she may have a run in with CBP or INS or even LEOs who MAY ask her for ID showing her legal presence in the US. With the expired I-94, she may be detained and taken before an immigration judge who will tell her to file the AOS ASAP. She will not be deported.

So order those tax transcripts and relax and file the AOS as soon as you can.

Sorry to jump in on this. i'm desperate to file the AOS and my husband doesn't have his tax forms so but judging from the last response to this thread you said something about not needing to file them as the dealine for 2011 isn't here yet? So does that mean I can send along without that sheet and if they need it they will request it at a later date?

The deadline to file 2011 taxes is in April. So, the most recent tax year is still 2010, for the next month at least. If you send off your AOS forms now, you should only need the 2010 tax transcript. If they want to see the 2011 tax return, they will send an RFE for it, and by then, it should have been filed already.

Guys,

Thanks for all the replies but I am still little confused. I guess I didn't clarify my main question. Since I filled electronically and have a digital copy of my taxes (in pdf form), even if I get a copy from IRS it will not be signed. And IRS will just send me a printout of my 1040.

So my question is that do the tax forms that get attached to AOS need to be signed or not?

From all the replies my guess is that I can just attach the print-out (from my records or the IRS one) without any problem.

A tax return transcript from the IRS is not just a copy of your 1040. It includes every bit of information about your filing, which is why when you use an IRS transcript you do not need to send anything else like W-2s with it. It contains all the information that was accepted and processed by the IRS for that tax year. It has no need to be signed. The IRS is verifying the information is correct, as it comes straight from them. Here is an example of what one looks like but without amounts.
