Hello fellow VJ users,

This is my first post, ive always been reading peoples posts on this forum. I am so sorry if i posted in the wrong section, mods please move it if you feel its in wrong place.

QUESTION IS-

I filled for my i485 and i140. i140 was approved few months back. But i485 was still pending. My form was from april 14 2011. Its in texas service center, where my case is, it took 6 to 8 months. I kept up with it daily. I saw they were working on april 2011 cases now. So i knew my time was coming. Yest i checked my status on there, and it said... the following..

On March 7, 2012, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to another office for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

Ofocurse i did alot of research, and i dont think it means anything bad. not sure. Mine is a Employment-based adjustment application. Me or my employer have not recieved a notice yet. I live in texas and my service center was in texas. I have no idea what this means, or that it probably doesnt even mean anything. I thought id ask you guys. Any advice or comments is appreciated.

Thanks :)

That's not typical. Cases are not usually sent to the AAO unless they've already been denied and you've submitted an appeal. I suggest you call USCIS and try to find out what's going on.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

This usually happens when the I-140 is denied and an appeal is filed. Check again to make sure the I-140 was really approved. Also if you ever had a previous I-140 denied, withdrawn, or re-filed, that might be messing things up.

In any case, you should follow up with USCIS, or the attorney if you/employer are using one.

Thanks for the response everyone, more info-

3 years ago i had applied for i140 and i485, and my 140 was denied, which automatically denies 485. I did a motion to reopen, and it was sent to appeals. That has been there forever, and it is still processing in appeals. The reason i got denied was because of my employer issues. However, i re applied, this time made sure everything was perfect, got the best lawyer, resolved all the employer issues, and then last yr i got my i140 approved fianlly. Now we are waiting on i485, and then it was sent to AAO.

Thats the story. I dont know if my previous denial that was filled for MTR is coming in the way for this new application.

If they are tied to the same labor certification, it's definitely the old I-140 thats screwing things up. It's probably not since it's different employers and they already approved the second I-140. Still, if that is the case the attorney would need to withdraw the first I-140.

If they are tied to different LC's, then it could just be a glitch of having two I-140's. I would still have the attorney follow up in any case.
