Hi guys, first post here so please go easy on me :)

I am a member of the US Air Force and have been for more than 6 years. I've met my fiance in another country when I visited my family a while back in 2007. We kept in contact ever since and about a year ago, she came to the US as an international student on an F1 visa with an I-20 form. We are very much in love and I want to help her achieving the American dream and also spend my life with her. We are getting marry next week in Las Vegas. I am stationing in Las Vegas while she's going to school in Boston, MA. Will this be a problem when i applying for a petition for her with the form I-130 and I-485? I can put her address as my current address and keep it like that.

She is planning to transfer school to my city eventually after her 2 years are done. Beside the I-130 and I-485, what else do I need to do to apply for an expedite green card under military spouse status? The I-485 require a medical exam so I am planning to get it done since she did it more than a year ago before leaving her country to come here. Has anyone else been in my situation before? How long did the process took for you?

Why the expedite? Are you being deployed? It does not sound like you intend living together which may be an issue.

Why the expedite? Are you being deployed? It does not sound like you intend living together which may be an issue.

Yes i am deploying at the end of this year. She will live with me during the school break, summer break and holidays break. Is it still an issue even though im military and travels a lot? Do they come by my house to check often? I can use my address for all of her application to prove that we are living together.

They usually ask for orders for expedite. If you don't have them yet, then request for a letter from your CO. But the end of the year is still far away, you have plenty of time to get AOS rolling and approved. We had ours expedited because we only had a 3-month time frame for AOS, and our AOS was completed in a little less than 3 months. I'm not sure how it works if you don't live together though.

I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

the point is though, that, in fact, you won't be living together. After two years, she has to file for removal of condition on her 2year green card and part of that application is to provide tons of evidence of an ongoing relationship - anything that shows ties you have... both names on rental leases, bank accounts, loans, tax returns... the same address on driver's licenses, birth certificates of children born to both of you and so on. De facto living on opposite sides of the country just makes them want to check out even more thoroughly and I can only speak for myself, but I wouldn't want that. I had one interview to prove that my marriage "is bona fide" a long time ago and I hated it. There's nothing worse than the feeling of having to prove what you KNOW is real but you wonder if what you have will be enough.

05/2007 - got married in Germany

05/2007 - filed I-130 via DCF in Frankfurt

08/2007 - interview to prove bona fide marriage

09/2007 - hubby PCSed to GA

10/2007 - hubby deployed to Iraq

04/2008 - hubby on RnR in Germany

08/2008 - received CR-1 visa

12/2008 - flew to GA alone to welcome home the hubs

09/2009 - PCSed to CA

03/2010 - we're pregnant!

06/2010 - applied for German "BBG" to retain German citizenship during naturalization

08/2010 - BBG granted

09/2010 - filed ROC

12/2010 - received 10 year GC

12/2010 - our little miracle is born!!!

01/2011 - PCSed to Germany

01/2012 - filed N-400 for overseas naturalization

They won't come by your house.. but somewhere in the forms you will need to disclose that she is on a student visa in Boston. Not sure how that will affect your application though. I too am in grad school and hubby leaves me often for weeks and months at a time.. But I live and stay with him here in PA. In your case she is the one away. Why not file for AOS after you come back from deployment and she is done with graduate school?

Adjustment of status- its what she needs to do to get a green card. You could try asking for help from your JAG officer, my hubby went to one in Fort Benning before he sent off our forms. This is the VJ guide. Wish I could be of more help but I came here on a k1 visa. I'm sure the experts will chime in soon. Goodluck! :)
