I was wondering if I can claim my 19 year old stepson in my 2011 taxes. He and his mother, now my wife, arrived in the United States June 3 2011 on a K2 and K1. We got married on June 7. My wife received her green card in October of 2011 and my step son in February of 2012. He did not work the entire year.

Yes you can if you provided for him. If he does not have an SSn you will need to fle a paper return but he is now eligible for an SSN s go get one. wait a couple weeks and file electronically. It takes a couple weeks for the IRS computers to get his SSN in the system.

As an LPR he is required to file a tax return even if he had -0- income, just check off that he can be claimed on your return, then claim him as a dependent on your return. No problem. Since he was not a permanent resident until 2012 he will NOT need to file a 2011 tax return.
