I met an Australian woman who resides in Spain. We want to meet in person. She is trying to come to the US so we can spend time together. She is trying to come over on the visa waiver program. If we decide to get married what will we need to do so that she can stay here. We want to do everything legally.

If we decide to get married what will we need to do so that she can stay here. We want to do everything legally.

The Visa Waiver Program is not intended for a planned Marridge and is considered Fraud. That don't seem legal does it? The Intent appears to Marry.

Go there and marry her and do it like we all do. With a Petition

Also, what a TRICK to get around Meeting in Person and then knowingly say: I fell in Love and want to Marry Now. Thats FRAUD and you know it.

Maybe it would be a good idea to try to know each other and spend at least this first time together and then think about marriage. Just my two cents...I am on this forum daily and there are way too many people for whom it doesn't work out - and the most common reason is not spending the time to know the other person before rushing into marriage.

Against TOS

There is absolutely nothing wrong or illegal with marrying in the US on the VWP. She can then go home and you can petition her for a CR-1 visa as her spouse. What she shouldn't plan to do is come on the VWP, then stay in the US and apply for adjustment of status.
