Yes you have human rights, they give you life on the planet, not necessarily in America. My advice is that if they want to see you, make it happen. Jump through ALL hoops until you are USC. Until then, it's their ball and they make the rules.

All I have to say is that I have been my best as a girlfriend and wife to him.

if he is not coporating with USCIS, it means that he does love me enough from now on. now he is regreting.

The others doesn't understand my story, I am sorry that I didn't pay much attention about what I typed. I didn't think anyone will read my posts.

For the douter or hater out there, I am just going to say. if this is fraud marriage, I suppose to find someone my age, since I am pretty and from rich family.

Instead of marrying whoever, I married someone I love.

The immigration officer can't tell me who to marry and how old my husband should be.

My husband love me and will be with me no matter what. even I went back to my country, he will be with me.

so if I get denied, I would only say the immigration system is wrong.

period.

OP we are here to help you in anyway we can but if you don't open up your eyes and see what we are telling you so what is the point of helping you. Everything we said you just say oh my lawyer said is it ok and then you threaten to kill yourself too. No one said this was going to be an easy road to go though and everyone on VJ is here to make the road a little less stressful. Some of the things you said don't make sense to us and we are trying our best to help you.

No one is saying your marriage is fraudulent. They are saying USCIS probably suspects it is fraudulent for whatever reason, and that not cooperating with USCIS is only going to further that suspicion even if it isn't true.

The problem is not the immigration system itself, it is the number of people who DO commit fraud in order to get a green card. As a result, USCIS must look for red flags and make their best guesses at fraud, and one of the ways they verify is through home visits. What your husband does not seem to realize is that these can also work in your favor by showing immigration that you are a legitimate couple.

You don't have to let USCIS into your home. But not cooperating when you have nothing to hide will only hurt you in the end. USCIS has nothing to lose by denying you, but you have a lot to lose.

Immigration is not a right as odd as it could be and anybody who file a petition should learn to drop all his attitude. In this process Psychology is your best friend. I had my fair share of consulate hardship and it shaped me into a smarter, stronger and more humble person I am now. OP, I hope you learn to grasp the messages positively. God bless you.

No. The system actually works pretty well. Most of the time when people report on VJ that they were denied AOS it's usually pretty easy to see why the IO denied them. Many of those people were legitimate sincere couples who were just naive, and didn't realize that the interview was a test. That's understandable if they filed everything on their own without doing any research beforehand. It's downright tragic when they have an attorney who didn't properly prepare them. I'm afraid that's what happened to you.

Your attorney told you "You have nothing to worry about. Your relationship is real." How the heck is the IO supposed to know your relationship is real? Can he look into your eyes and tell that you're in love? No. They look at the evidence they're presented with, and determine if the evidence indicates two people who live as a married couple lives. Your attorney should have told you this. Did your attorney mention that a Stokes interview was possible? It's still possible. It's something you might want to ask about.

Your attorney should have also told you that a home visit was possible, and he should have told you how to handle the situation and what your rights were. He didn't, and it obviously came as a complete shock to your husband. Your husband's reaction was understandable. What's not understandable is why your attorney didn't prepare you in advance for this possibility.

Every angle I look at this from indicates to me an attorney who didn't properly advise and prepare his clients. Why would an attorney do this? Well, one possibility is that an intending immigrant who is facing deportation is much less likely to kick about writing fat checks for legal fees. I'm not saying your attorney is trying to fleece you, but I haven't heard anything yet that would completely discount that theory.

If your AOS is denied then you've got 30 days to file a motion to reopen. If I was in your shoes, I'd be consulting with some other attorneys. The ones who say you've got nothing to worry about are the ones you should walk away from. People don't hire lawyers when there's nothing to worry about.

USCIC doesn't care if you are pretty. They don't care if you are from a rich family. They care that you comply with their rules, and prove to them, beyond the shadow of a doubt, that your marriage is not for convenience.

Immigration cannot tell you who to marry or how old he can be, you are right there. What they can tell you is that your failure to cooperate with them in their investigation has not worked in your favor. They can tell you that your failure to allow them to complete a home visit, and be assured that you are living as a married couple has brought your bid for adjusting through AOS to a halt. They may go as far as to tell you that you are denied, and you are not getting a Green Card, and that you will be going home.

I'm glad you believe your husband loves you, and will go with you back to your country. Which country is this ?? You have no information in your profile, no time line.

The Immigration system has not let you down here. Your lawyer has, and your husband and his attitude has not helped your case either. He does not seem to understand the gravity of your situation. That's not ballsy, it's foolish.

You have come on to a forum where there are many people who are trying to help you. Getting angry, calling them doubters or haters when they give you advice you do not want to hear, doesn't make them wrong. You have been given some very good advice, which you are refusing to heed.

You need a new lawyer, and now. You need to take what has happened seriously. You need to prepare yourselves to reopen your case for AOS if you are denied. 30 days may seem quite a while, but when push comes to shove, it is no time at all.

I can explain it to you. But I can't understand it for you.
