We are a little confused. Question #38 on the DS156:

Have you ever been refused admission to the U.S., or been the subject of a deportation hearing or sought to obtain or assist others to obtain a visa, entry into the U.S., or any other U.S. immigration benefit by fraud or willful misrepresentation or other unlawful means? Have you attended a U.S. public elementary school on student status or a public secondary school after November 30, 1996 without reimbursing the school?

My fiance was denied entry on the visa waiver program due to a lack of proof of funds to support himself while visiting. Do we answer yes to this question? Or, is it only if he was denied entry due to "fraud or willful misrepresentation or other unlawful means"? We are quite confused by the wording of this question.

You should answer YES, because his admission to the US was refused.

We had to answer "yes" to this question. My (now) wife was refused entry in 2010, had her tourist visa cancelled, and was sent back to Mexico. It was not a problem. They did bring it up at the visa interview, but she briefly explained what happened and they moved on.
