From the little you said, it just sounds like they were not comfortable with the current situation. Your wife can not prove she can take care of you if you were to go to the states. And the big age difference, was a big red flag. Since you 2 are married the next step is not going to be easy and is going to take a while. When you wife gets the paper back, in about 4-6 months she can appeal it and if they will let her she can provide more information. If they do not accept then in about 2 years if she can get a good immigration lawyer, she can go through a process and try to petition you again. But to be honest we are talking years. I had a friend who was married to a moroccan and get denied, it took her 4 hard years, but possible. Is there any way she could live there with you?

i need help or advice plz im really worred for my wife she dont like to eat from day that she know what happend and she cry lotttttttt , we really love each other god know .

if the CO told you that, it means she/he completely denied your petition and she will send it back to USCIS to revoke your petition.

I'm not very familiar with the Board of Immigration Appeals processes, this isn't something I have followed very much. I know of a couple of cases that have gone through the BIA, but their USCIS revocations weren't because of the inability to rebut the general "non bonafide relationship" reason, there were very specific ineligibilities under the INA which applied to those cases such as fraud and/or misrepresention.

The BIA 'may' have the authority to not agree with the revocation of the I-130 and have sent it back to the USCIS for re-adjudication, not sure about that. Did you respond to the original NOIR/NOID for the I-130 within the timeframe the USCIS asked for it? If so, in your mind did your rebuttal address the "non bonafide relationship" the NOIOR/NOID specified was the reson for the return? Did the USCIS provide a specific reason for the final decision to revoke the I-130?

I know one thing, If I received a 2nd NOIR/NOID that is another opportunity to address this petition return, I would take it. If "bonafide relationship" is the only reason given to you for all of this, then tell the story of your relationship from the beginning up to current date with proof of spending time together, plane ticket receipts, copies of passports, letters, photos, emails, phone records, affidavits from family and friends, co-mingled finances, etc.

I do think that you should seek legal advice on this one from an attorney experienced in this specific area of family immigration, as it does involve the Board of Immigration Appeals and a previously revoked petition. Once a petition is officially revoked there is a marker placed in the beneficiary immigration record, this may need to be addressed by legal counsel. Legal counsel can also assist you with the 2nd NOIR/NOID.

Actually, he is no where near having to worry about an appeal. It sounds like USCIS hasn't even gotten their returned petition yet. If I'm wrong OP, then please clarify. After your papers are sent back to USCIS, the USCIS will send you a NOIR( notice of intent to revoke). This will let you know why you were denied, and they will give you 30 days to respond with more evidence. Getting the NOIR will take approx 6 months from when the USCIS receives the petition back. They will let you know when they have it. From that point it takes about 6 months. It took them almost 9 months to send us out NOIR. IF the USCIS doesnt think your response is good enough, they will then revoke their original approval and give you a certain amount of time to then file an appeal to them, which will then be looked at by the board of immigration appeals. If they reaffirm their original approval, it will then be sent back to the embassy for another interview. I hope this clarifies things for you

Seems like the CO didn't like some of the things on your petition and being from a high fraud country is a red flag. The reason to send the file back to USCIS is with the intent to deny.

Hopefully people with Morocco experience can provide a better assistance.

I do not know much about the culture of your country, but a 32YO foreigner, from a high fraud country, who marries a 50YO woman with 4 kids, who needed a c0-sponsor who is her brother (she is below poverty level) could be a red flag in the CO's mind.
