I'm a US Citizen. My wife followed me here because I got a contract job and we didn't think we would want to stay long. 5 months later we applied for everything with the lawyer. We filed in Dallas, then moved to Oklahoma late last year. They asked me to send in my taxes and I did. We already did the fingerprints and all that.. A few weeks after I sent in my tax return we got the employment card so she can work. Looking at this: https://egov.uscis.gov/cris/Dashboard/CaseStatus.do it currently says:

Request for Evidence Response Review

On February 1, 2012, we received your response to our request for evidence. This case is being processed at our NATIONAL BENEFITS CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

Once a timely response to the request for evidence is received by USCIS, we review the evidence or information you submitted. If you submitted the requested evidence, we continue with the adjudication of your application or petition in light of the new evidence.

How much longer do we have until she gets the I485 or at least have a "next step" ?

Your guess is as good as ours-- there is no determining the time it takes.

However, to state the obvious you should receive something "within 60 days"-- so at least there is some kind of time frame.

Day 0: 02/25/12: Mailed concurrent I-130/AOS Package to the Chicago Lockbox

Day 2: 02/27/12: Package arrived at the Chicago Lockbox.

Day 5: 03/01/12: Email acceptance confirmation received for Forms: I-130, I-485 & I-765.

Day 13: 03/09/12: NOA1s received for Forms: I-130, I-485 & I-765. Biometrics letter also received and scheduled for March 27th.

Day 24: 03/20/12: Email notification for RFE.

Day 27: 03/23/12: Hardcopy RFE received in the mail.

Day 31: 03/27/12: Biometrics completed.

Day 40: 04/05/12: Mailed off the RFE.

Day 44: 04/09/12: RFE Delivered.

Day 46: 04/11/12: USCIS received RFE and case updated online.

Day 55: 04/20/12: EAD approved!

Day 60: 04/25/12: Received 2nd "EAD in Production" Email.

What visa are your wife on? Usually they response the RFE (approval of EAD, AP and interview appointment) within couple weeks after they receive it. Mine is 10 days, others are like 15 days. Their windows time is 60 days, so you should get an update within next 3 weeks. Otherwise you need to call them to see what's going on. By the way, when she moves, short or long term, she has to update AR-11 online or by mail. Make sure there is someone picks up your mail when you guys are away. Returned mail is not funny with USCIS. Good luck.

However, to state the obvious you should receive something "within 60 days"-- so at least there is some kind of time frame.

Well, she has the i-94 which expired. She got the I765 a few weeks ago. We done the doctors appointments to get the clean bill of health, sent that in with everything. We sent in taxes mid January when they asked for it in December. The only two receipts we have is the I765 and I485. However; I have no idea what these mean: RFE , EAD , AP.. sorry.. we did file the AR-11 online which they received. We know because they send the I765 to this address.

Awesome. Do we need to do a I-130? I don't have a receipt for that - at all.

I believe your attorney did submit one if she adjusted from an expired tourist visa (expired I-94 you said so I just guess) when she was in the US. If you need more help, please provide more info and I believe your attorney knows what he is doing (some doesn't know what is what...) You need to call him to verify if he did receive a notice of action for I-130, the online status tracking can tell you that. Mine was returned and I had to call a number of times to get it redelivered; couldn't take any risk with USCIS. Good luck.

If I were you, I would sit down with your lawyer and thoroughly go through what exactly he has sent and what not. It seems very odd to me that he didn't realize to submit your tax documents with the original application - those are very standard documents that need to be included with the affidavit of support to prove income. It also seems odd that you don't have a receipt for I-130. The I-130 is essentially what establishes eligibility for AOS, i.e. the I-485 - I would assume that since you have recived the EAD (Thas is what you mean by saying that your wife received the I-765?),USCIS must have the I-130 too, otherwise the process would have halted a long time ago.. Still, whatever the case is, you shouldn't just blindly leave your AOS case in the hands of your lawyer. Though there are many good and professional lawyers out there, there are just as many crappy ones who really either don't know what they are doing, or don't care - and the best way for you to protect yourself is to familiarize yourself with this process throughly and then stay on top of your lawyer to make sure everything is running along smoothly. After all, it is not his marriage and life that is at stake here - it's yours.
