How many years of tax returns to I need to provide as a petitioner for my wife's I 130? she is here on a working visa, has been working here as a project engineer for 3 years and makes well above the poverty line.

I made above the poverty line in 2011 but didn't work at all in 2010 due to disability.

You need to provide the most recent year only. You also check a box stating that you filed for the past 3 years (or provide an explanation of why you did not if you weren't required.

Thanks, I filed in 2010 but the problem is that I did not make any money that year due to injury. Is that going to be a problem for me as a sponsor? Are they going to give her work a authorization regardless? Are we going to be required to get another sponsor because I did not make money in 2010? I know they don't require the last 3 years of tax returns but they do ask how much money you made in each of the last 3 years. I guess I'm asking if that is going to be a problem for me as a sponsor.

I only recall it asking your current income and for the previous years tax return and if you did or did not file the last three years and if not, why.

If you currently make enough money it doesn't matter how much you made in 2010.

You can also send in a copy of the last 3 years since they do ask you to put the amount, you might as well show the proof. Just make sure you check the box that says you are including the last 3 years. Also, it only matters how much you CURRENTLY make. So if you had income that meets the requirements in 2011 and you have filed your tax returns, then you are fine!! Good luck

My bad, you are right it does indeed ask....I did not recall because my situation did not require a number there. (I had to include an attachment with the applicable tax law showing she was not required to file those years)
