GC and EAD progress but none for the AP

Hi Guys,

I've applied for AOS along with AP and EAD and USCIS received it on Dec 22, 2011.

I had some problems with receiving mail from them since we can't get mail to our house, and they disregarded the "C/O" box where I put our PO box and the notes I've attached requesting them to send all mail to our PO Box.

Anyways, I've fixed that with them and since then have received all mail, done the biometrics and received a date for the GC interview (which is next week!), and last Friday and today again, I've received notices that my EAD is on its way.

My problem is that since the first NOA1s were returned to USCIS, my AP case status on the website still states to this day the notice about the returned letter. Now I've received letters from them confirming the address change and I've also spoke to a tier 2 person who assured me that the address is changed, but I'm wondering why nothing has changed on my AP case?

Do usually nothing happen on the AP case because you get the combo card for both the EAD and AP?

Or should I be worried that there is a problem with my AP?

I have an important event back home on April 1st and I'm not sure if I will get my GC by then, so I really need the AP to be able to go.

Is this a normal situation or should I start freaking out and schedule an infopass to try to expedite my AP? (It's been 2.5 months, past VJ timeline for AP).

AP and EAD are useless when your GC is approved at the interview. I wouldn't waste anymore time wondering or worrying about this issue.

Inky is correct. GC cancels EAD and AP. Based on apoeoval, ask for a stamp in your passport just in case your GC doesn't get to you in time.

OK, so basically they are going to cancel it at the interview?

So what happens at the time I'm waiting for my GC after the interview? I can't work or travel?

If I get approved on the spot at the interview will they agree to put the stamp in my passport right away?

What happens if I don't get a definite answer at the interview? I'm stuck until they officially approve me?

Not that my case should have a problem, we are happily married and all of our evidence documents for the interview are ready, but who knows what could happen there..... Maybe they will ask for more evidence?

If your not approved then you have no green card and your AP and EAD are not void until your GC is issued.

You are going to be cutting it close for an April 1 trip.

Usually the EAD is combined with AP. Often you don't get messages about the AP separately, because the system isn't set up to properly indicate a combined item. They'll give you a notice about one thing (the EAD). I don't know what VJ timelines say, but 3 months is a normal time to get approval, so I wouldn't worry if it's only 2.5 months.

If you are approved at your interview, you can say that you have travel plans and ask for a I-551 stamp in your passport (which is proof of permanent residency). Usually, they don't like to give those stamps out, but if you ask nicely and bring proof of travel plans they might do it for you.

If you are not approved at interview, then you can use your AP until the point that you are approved. If there is some delay, and you get approved March 27, you probably won't have the GC in time to travel. You could try to get a stamp in the meantime.

Making travel plans around interview time is always problematic.

I know but I never thought i'm going to have the GC interview so soon, I was only hoping to get the AP on time, and I haven't purchased the tickets because I want to be sure I can go.

I am not making those plans, no one asked me when to schedule the family wedding I want to go to... I would prefer to stay here and be relaxed and not care about when I get my GC but I don't want to disappoint my family.

So anyways, if I get approved I should ask them for the stamp, and if they won't do it, I should wait a few days until I get the formal approval letter and then go back there right? (at least I'm lucky the Phoenix office is very available for infopass and you can get one in a few days.

And if I don't get approved on the spot (I hope it doesn't happen!) then at least my EAD and AP will still be valid right?

Yep. Take proof of your travel plans and hopefully you can get the stamp at the interview. if you can't you can either try and wait for the GC to be mailed, or you can organise an INFOPASS after you get the approval email/update and get a stamp then (because you'll be approved on the system they should have no issue giving you the stamp)
