Sounds like a ban for overstay - don't quite understand why OP is surprised... Try here - whole subforum on waivers : http://www.visajourney.com/forums/forum/113-waivers-i-601-and-i-212-and-administrative-processes-221g/

In summary - your husband need to prove hardship and apply for I-601 waiver.

Well I'm confused. She says her hubby went to pick up his passport thinking it was a visa, but she has posted in the K1 forum, and her info says a K1?

I can explain it to you. But I can't understand it for you.

You will need to file the waiver to have the prior overstay forgiven. If you take no action within one year your application will be considered abandoned. Suggest you at least consult with an immigration attorney as you will need to prove that you cannot move to his country and you cannot live in the US without extreme hardship to you unless he is here with you.

Moved to waivers section as this is a question and issue about waivers.
