I am also a lady who is 22 years older than my fiance, who is 40. We both have grown children. Childbearing in the future is not an issue. We were introduced by my friend's sister, not online.

We were asked about it(the age difference) at the interview, at least I was. They tag teamed us, separated us, then got us back together to check our answers. When this question came up, I laughed and said,' Yeah, but he is the OLD ONE!' The consular officer laughed and said, 'My wife is older than me, too, and she says I am the old one. I guess it all depends on the worldview and past experiences of the interviewer.

We are still in a holding pattern, so there is no resolution any time soon.

Yes, it's a red flag and more if the woman is older.

What makes you think your husband will obtain a K3 visa?

Excuse me? Are you being rude, sarcastic or am I not reading you post correctly?

What makes me think my husband will obtain a k3 visa??? We have a bona fide mariage and I have proof. I may be older than he with a big age difference but I won't let that interfere with my decision to be his wife and bring him to the US to be my lawful wedded husband. Thats what makes me "think" my husband will obtain a K3 visa.

Christina, do not be offended. I think he means the K3 will probably be closed at the NVC level and your husband will probably get the CR1.

But I have seen the K3 go thru in rare cases

May 24, 2011 NOA1

Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

INTERVIEW RESULTS-APPROVED WITH 14 WEEKS AP--but he got his visa in 56 days!!!!!!

I'm going to answer two posts in a row the same way. When you don't know, it's best to read and learn instead of speculating or providing information you haven't verified as accurate. Your wrong.

I wasn't trying to lead anyone astray. That is what I was told, and I was passing on the info I had. Not everyone has all the info handy, and info is passed back and forth based on what you know. If I'm wrong, I'm more than willing to take back what I said.

By the way, thank you for correcting me. That said, you don't have to come on that strong!

The first sentence was simple straight talk. The second was intended to get your attention. CR1 is the visa your husband might actually be granted. K3 visas are rare as hen's teeth for more than two years.

Learn the CR1 process. Become a professor of it. Read all the threads about age difference, particularly the ones about the woman being significantly older, and even more particularly when that scenario is outside the cultural norm for the foreigner.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You'll want to discuss the reverse age difference issue in the applicable regional forum too and get their perspective. Evacuate all thoughts of discrimination or unfair treatment. Relationships outside cultural norms are a big red flag, particularly from high fraud countries, (India, not Australia but regardless of current residence, he's Indian.) because such relationships are often entered into fraudulently (mostly by the foreigner) with the intention of scamming an immigration benefit. You need to KNOW this, so you can be PREPARED to DEAL with it in a way that will mitigate the impact of the red flag. You've got some months to prepare. Start now. Again, waste no time being offended. Start preparing.

A common belief would be that I-130 is being processed in less time these days than in past but according to my personal experience (my wife called USCIS and was told that they are back logged and still doing petitions from August 2011 for I-130). So they are not doing it in the given 5 months time. People who applied in August are getting NOA2 in late February or early March.

So, why would they keep the K3 option open if they are just going to keep the I-129F petition on a hold till they can approve I-130 and the petitioner/beneficiary has to go for CR1? Why give someone a false hope that by applying for a K3, they could possibly reduce the separation time between a married couple?

Note: I do not mean or intend to contradict or offend anyone. I am just confused and wondering, looking for some answer for peace of my mind.

Agree with your point, but this is gov, they work in the way they like! Down the road, they may close the door for K-3.

I think we all have to realize when all these different paths were created to get our love ones here we had a full running government. Enough people to do the job. The job market you know has been slammed and first to go will be government.

I think also they in theory probably thought K3 get people here faster but again you have to have people to process these applications. We think ours is the only one but you can see by just this website there are millions of us in the K1 and CR1/IR1 groups.

You know American government unlike many others is always evolving and we do live in a pretty great country that adheres to complaints. So do write your congress people, senators get heard. Enough noise will make someone look into things.

Why aren't we submitting our reviews of the embassies to our State reps, senators and governors? They need to know also. They don't have eyes and ears everywhere. We are the voice they need to hear.. I say let them hear from us whether good, bad or ugly. A review of every embassy just like we post here should go to your state office. That same person you emailed to help when things got logged jammed.

K3 visas came out of the life act, in 2001, back when the CR1 and IR1 processes were taking 4 to 5 years. The K3 reunited couples within less than a year and continued to do so until late 2006. By then the CR1 and IR1 processes on the USCIS side were joined, so the petitions were approved the same day. This obviated the time savings for the K3 or reduced it to a matter of weeks faster than an efficiently managed CR1 or IR1 process. February 1, 2010, NVC changed their procedure in a way that made the K3 virtually obsolete.

Questions like "why do they still....?" falsely presume there is a single "they". There is not. There's USCIS and State Dept. two agencies that have been fueding as long as they've both been involved in the immigration process. USCIS still touts the K3 visa. Dept. of State's NVC, effectively executes it, dead on arrival.

Well I see it this way especially reading over and over these reviews where we read "They didn't ask for any evidence and didn't ask any questions or very little questions". So that means a decision was already made before the Beneficiary came to the interview. So how do you combat that.

I State folk need to know what whats happening at all these embassies. It's really not about whats not working its implementing whats already there. Everyone deserves the right to a fair and impartial interview.

It would be soon cool I mean looking just at these boards I am estimating about 3 to 7 people from various embassies with USC's from various states each and every day. We keep them coming start a grass roots. The State Reps will be like "what in the world is happening here". And who knows
