hey guys my case is currently is in process of being returned to USCIS USEM said to contact NVC within few days for further details i called NVC numerous times for the confirmation of my case if they have received it it's been 3 weeks they haven't received it yet nor they have any info i'm confused i got my senator involved and we were trying to know the reason of this revocation so he got a short reply from the Department of state Washington i called USCIS confirmed me that i can file CR-1 Meanwhile your I-129 is in process of being returned because its two different Petition so meanwhile my fiancee next month will come to Pakistan we will get married and file for CR-1 and we can withdraw later on K-1 once it arrives USCIS i have a Question is that i have one single name and i don't have a last name neither on my passport nor on my birth certificate in i-129 form i filled my dad last name as my family name so my interview letter came with last name of my dad is it ok now to use the name last name on the CR-1 or i should use only one name i have in my passport and then here is the email from the DOS sent it says

i reviewed the case with the embassy in Islamabad during the review of documents submitted in support of MR Mohsin immigrant visa application the interviewing officer became aware of the information was not available to USCIS office at the time petition was approved As result petition was return to USCIS for review

just because of this they are playing with our emotions and how much we are stressful due to this i'm so confused what info they have USCIS don't have they asked us to submit joint-sponsor papers after interview we did can you guys advice what could be reason any help in your view Thank you

Are you the USC or the Beneficiary? So did they return your I-129F to USCIS because the name didn't match your passport or birth certificate? Does your passport have your dad's last name or it only contains the first name?

i'm the beneficiary no US Embassy sent me an email on 17 Feb that they are sending my case back to NVC with recommendation of revocation

i called NVC numerous times they said we haven't got it yet me and my fiancee and our attorney sent many emails to US embassy they haven't replied any of us no it doesn't have my dad's last name My name is Mohsin only in my passport my dad full name is Abdul Khalique Baloch so i filed my i-129f as Mohsin Baloch cos its a family name do you think i should refile with the similar name with last name or just Mohsin because Mohsin is the one name on my passport and birth certificate

After the interview it looks like they put you in AP, did they give you a document explaining why they are sending your file back to NVC? Are they keeping your passport or did the embassy give it back to you?

Generally if they need more evidence or documentation they keep the application at the embassy but if they are returning it then that seems like a full denial.

I am sorry you are going through this. Talk to you attorney and find out your options.

I have heard Pakistan is a tough when it comes to interviews and almost always are put on AP. If any appeals fail then it's recommended to marry in Pakistan and start the CR-1 process.

This is just a bump in the road, hang in there and eventually you will be with your loved one.

thank you very much for your encouragement and kind words 90% of Males going in AP because its Mandatory for Pakistan no they never tell a reason only USCIS after review can tell you and its a long wait USCIS need 6 Months to review if there is any documents needed they will contact my USC fiancee not me and if they reaffirm it will go back to US Embassy that's y i got my senator involved in it and he could only know that from them that the information they got from me USCIS was unaware of that where my basically my petition was approved other than that they can't have a doubt on our relationship cos i had bunch of evidences even keeping them for my CR-1 this way i can show i got engaged in Pakistan and got married also in Pakistan then there shouldn't be any doubts in their mind i don't know what is that info so we have decided rather than wasting time waiting on this we will file CR-1 start our stressful Visa Journey and wait about 8 months more and they haven't returned my passport i had my attorney sent them 2 days asking why they are sending it back and how will i get my passport and original birth certificate.

Looks like you are on the right path. This process is extremely difficult and if you can get through this the rest of your marriage should be a breeze!

Even another 8 months is technically a small a amount of time considering you will be with your fiancee/wife for the rest of your life. It sucks to be away from them but it just a sacrifice you have to make to be happy in the end.

As long as you are persistent, I know you will be approved.

its very much stressful me and my fiancee cried so much and were very much upset yes we haven't lose our hopes and we still have a faith and strong belief eventually at the end victory comes always for the honesty and truth our love is real and we both love each other alot we need to have patience and tolerance and that is the key to be together inshallah we both are struggling what ever error we have made with co-sponsor thing and this time we won't make any mistake we are hiring a very good and experience attorney my fiancee knows him for quit big time next month we are getting married and will apply for CR-1 and i was wondering since they will have our case for K-1 would it still take time for them to approve me like i got my first NOA2 for K-1 in 94 days

Ourhappyending,,,,I am finacee of Mohsin, and I just want to say thank you very much for your kind and encouraging words, we do need it,, and NO we will never give up, our love isnt define by a visa, yes we are very much eager to be together, and thats y we are not waiting for them to send back our case to uscis, rather we are getting married on 29th April, and I will file the CR1, I will also stay there with Mohsin for 2 months, so we will make the most of that time together, untill they decide our faith,, once again thank you for you encouraging words,, it means a lot.
