Hello to all Vjers! I know it's early to ask this question because I just recieved my NOA1 few days ago. But, im trying to gather the required documents as early as possible. My question is regarding affidavit of support, I know I needed a co- sponsor because my fiancee make less than the required income for house hold of 4 (Me, her and her 2 kids). Her mum is ready to be a co-sponsor, she made enough money and doesnt have any household or dependant. My question is,

1. Does her income has to cover her, and my pentitioner (her daughter) and her kids (her grand child) or just only me ?

2. What document(s) does she really need to send together with the affidavit of support form?

1. Does her income has to cover her, and my pentitioner (her daughter) and her kids (her grand child) or just only me ?

Only you and her. The household is joint sponsor + immigrant + dependents. No dependents, so just you two.

2. What document(s) does she really need to send together with the affidavit of support form?

Either tax transcripts from the IRS or the WHOLE tax return + W2s, 1099s and any schedules and worksheets. Most people order the transcripts on-line for free instead of fooling with a tax return that can be many pages thick. She will need these documents for 2009, 2010 and 2011. She will also need to send proof of U.S. Citizenship or LPR status.

Income has to cover EVERYONE that is a dependent + you and your fiance(e). Review the form I-134 you will see you need to list everyone. With the co-sponsor 4 now becomes 5.

Understand that, but if her mom is to be the co-sponsor everyone gets included. There will be two I-34s completed, one by your fiancee listing herself, her kids and you, then the one from her mom, and for the guidelines she will have to qualify for everyone.

The co-sponsor's household is the co-sponsor plus their dependents. His fiancee and her children are NOT the co-sponsor's dependents.

I agree they are not dependents, what I am saying is the co-sponsor much quality using the total number involved, including the co-sponsor... which is 5, on the I-864P

Question 8 states

The following persons are dependent upon me for support. (Check the box if the person is wholly or partially responsible)

The fiancee and children are a totally different household all together, the co-sponsor doesn't support them in any way. The co-sponsor doesn't list anyone, she's not financially responsible for them, only the intending immigrant.

So the co-sponsor income only needs to meet the I-864P guideline for two people, thus they can have a lower income requirement then the sponsor that needs to meet the income requirement for 4?

"The US fiance is ALWAYS the primary sponsor, but may have a co-sponsor. If there is a co-sponsor, both the US fiance and the co-sponsor will EACH have to fill out the affidavit I-134 or I-864 and EACH will have to provide supporting documentation."

"Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will be immigrating, and his/her own household."

"While there are no specific income requirements listed in the I-134 form directions, you will be judged by the same criteria as the I-864 form requirements when they are issueing the visa at the foreign US consulate, so provide financial information for the I-134 with those guidelines in mind."
