Once our petition is approved and visa is given. My fiancee will be going back to finish her contract for work at least 3 months-5 depending on when we are approved. We cant wait for the Advance Parole to come. Is there a way, she can go back while the AP is in process and then I will bring the AP to her when she is she coming back and finally moves in? Is that possible?

No because they will know she left without the AP being issued. It will show by the issue date on the card.

Also if the AP is never issued she wont be able to return and you will have to start all over again with a new spousal process to come back to the USA.

No, you will abandon the AOS process and have to start over with a spousal visa if you do that. If she leaves the country before AP is approved and in her hand, the AOS will be considered abandoned. You will lose the fee ($1070) and waste a lot of time.

The K-1 visa has a 6-month validity, so she could finish her work and move when she is ready. Or change her plans.

I think we can wait for then to finish up. She gets incentive for bonus if she completes that is why. So the K-1 visa is good for 6-month. I also heard is 120 days which more like 4 months?

If she cannot finish her work before the 6 month expiry date, you need to choose between the extra money she may make versus the extra money you will lay out to do this over and the extra waiting time to move her here. What is more important?

I think it depends on the date of the medical too, so there can be some variation. You can also postpone the interview for a bit to buy more time as well. You might want to pop on in to the Canada forum and ask how long police certs and medical is good for, etc.

I think it depends on the date of the medical too, so there can be some variation. You can also postpone the interview for a bit to buy more time as well. You might want to pop on in to the Canada forum and ask how long police certs and medical is good for, etc.

By postponing the interview, what do you mean? Dont you have a certain day to do your interview once your NOA2 is sent? if not what do i need to do to postpone the interview to buy in more time as you claim.

No - Canadians have to book their own K-1 interviews an you have to book it at a certain time. Please see the Canada forums and the guides in there.

By postponing the interview, what do you mean? Dont you have a certain day to do your interview once your NOA2 is sent? if not what do i need to do to postpone the interview to buy in more time as you claim.

No, you can request a later date, or, if a date is assigned to you, you can request to reschedule. The Canada forum will have all the specifics.

No you cannot book anything until you have been cleared with P4 sent in the mail.

You have to email the consulate and tell them you want to post pone booking the interview or request a certain date in the future directly from them. If you just don't book an interview and leave it sitting they will close the case due to abandonment.

If you go to the Canada forum you will see the appointment trends there and be able to tell if you need to contact Montreal about a specific future date or if you will be ok just booking something when you have your P4 confirmed sent.

Once the actual visa is approved and issued, you can enter the next day (once in hand) or wait up to 6 months to enter USA before it expires. And sure, putting off interview will buy time as well prior to visa approval.
