Hi all, while filing I-864 Affidavit of Support, which should be taken as the most recent tax year, 2010 or 2011?

We have already filed taxes for 2011 but don't yet have a IRS transcript (as is usually the case for almost everyone)

So, do I attach the IRS transcript for 2010 or the tax filings for 2011 (given by our CPA).

Also, will it suffice if I send only the most recent transcript or do I need transcripts for the past three years?

Thanks for helping out with answers.

The Journey

Arrived on F1 visa on 25 Dec 2008. Graduated June 2011. Started OPT Sep 2011.

AOS applied March 21, 2012. GC approved June 11, 2012 & received June 18, 2012.

Exactly three months from start to finish,no RFEs.

Day 13,April 02, 2012 : NOAs received for I-130,I-485,EAD/AP & Biometrics

Day 36,April 25, 2012 : Biometrics Completed at Elizabeth, NJ.

Day 45,May 04, 2012 : E-mail notification for interview received for June 11

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.

Day 84,June 12,2012 : E-mail Notification registering PR status.

Day 87,June 15,2012 : USPS picks up GC from USCIS.

Day 88,June 16,2012 : Received two hard copy mails, approving I-130 & I-485

Day 90,June 18,2012 : 10-year GC in hand. End of GC journey, for now.

When is your interview? If it's before April 17, 2010 should be ok. If it's after April 17 you'll likely need 2011 tax info.

By the way, I've already received my 2011 tax transcripts. If you filed electronically the transcript can be ordered online within a very short time. I think I ordered mine a week after filing.

The most recent tax year is 2011. The 2011 tax year ended on Dec. 31, 2011. Federal tax returns are not due until April 17, 2012.

Since you have already filed for 2011, why not just submit a complete copy of your 2011 federal tax returns with the W-2s?

Grant n Karleen, am still to send in my papers, so the interview date will definitely be post-April. Thanks, will try applying online.

Sorry if my question seems repetitive and tiresome, but ALL pages? (I have 29 pages) or just the Form 1040 pages and the W2?

All pages. Your complete tax return is more than the 1040. Your complete tax return includes every page you sent to the IRS.

Bear in mind Transcripts are not readily available after filling your taxes but when they are a faster way of getting them is you can actually walk into an IRS office and ask for it to be printed for you or call while by a fax machine and ask for it to be faxed,

So it depends on how long you want to wait But if you file with 2010 tax returns now, Your applications will not be RFEd based on that but you'll have to take the 2011 tax returns or transcripts to interview if it is scheduled after april 17, 2011

Not sure what you mean but USCIS will not insist on 2011 tax returns at interview or through RFE until after april 17, 2012

I wouldn't count on it. If you cannot provide a 2011 return, they may put your case on hold until you file and provide either a transcript, or an IRS certified copy.
