I also got a RFE for this. I was wondering did you send in a new Affadavit of support with your tax papers? We are going crazy trying to figure out whether to include it our not.

I still haven't sent anything. I just received the request for initial evidence letter. It doesn't say that I should send new I-864 alongside with the tax return.

Yes, I got that. The thing is that some say that I should send tax transcripts too. Some say that I have to have all W2s and every document that's mentioned in the tax return that my mother-in-law has. I just want to make sure that I have what I need and don't send something that they don't need and get my case denied.

Let me say it again. A tax transcript has everything on the complete tax return. What is complete for one person will vary from another person. You gave us a list of tax return stuff. It looks good, but there is no way for us to know if it is complete - we don't know your mother-in-law, or what she filed, etc. How one completes their taxes is extremely variable.

If you are sure it's complete, then you can send that in. If you are not sure, or do not trust your MIL's record-keeping, then we suggested to order tax transcripts, which include the same information. You will be sure a tax transcript is complete, because it comes straight from the horse's mouth, the IRS.

You can choose whichever path you like.

This is an either OR situation. Either send them a complete copy of the tax return you filed (and your MIL)with the IRS--i.e. Form 1040/1040A/1040EZ, W-2's, 1099s, etc--OR send them tax transciprts from the IRS. Most of us recommend the tax transcripts as it should what the IRS actually received and processed--i.e. cannot be faked and does not require all the supporting documentation to be sent too.

Tax transcripts can be ordered from the IRS website and usually take about 5 days to arrive. In a hurry you can have them faxed to you or you can go to an IRS office location and get them printed out while you wait. I have always ordered mine and received them in the mail.

I'll be sending the Federal Tax Return and the Tax Transcripts. Even though they said nothing about the second I will listen to you guys. I'm sorry but I just want all my bases covered. Tomorrow my mother-in-law will go to the IRS Office and ask for the transcripts. Would it be a problem if I send them both things?!

A tax transcript IS the federal return. Its what the IRS has logged from the entire summation of the return.

This is why the directions say to include tax transcripts, so you don't need 85+ pages of a return. Its 3-4 pages of the transcript which is the full summation of the return.

This is why the directions say to include tax transcripts, so you don't need 85+ pages of a return. Its 3-4 pages of the transcript which is the full summation of the return.

What do you want me to say?! I have no idea what that tax return. Same goes for the tax transcript. If you say it's the same thing I'll be sending the tax transcript then. What else do I have to do? I read all the posts. Some of you wrote things I do not understand. I did my part in this and I was hoping for my mother-in-law to do her part. Apparently she gave me the wrong thing. If I was the one that had to present federal tax return (or tax transcript, I really don't know if that's the same thing) I would have known what is what and what to file and present. New country, new life, new laws. Excuse me if I'm confused!!!!

I have the complete tax return for 2011 for the mother-in-law (a bit late of her to send it to me but ok). It's 80 pages! So I should send all 80 pages?! And since my wife is a student and in 2011 she didn't make more than 2000 dollars as part-time all she needs to write is a letter, right?

Just because she was not REQUIRED to file does not mean she would not benefit from filing. It would be a simple return to file and she could easily do it by hand for free and get a refund of most if not all taxes withheld.

The other side is proof of income in the future. It won't matter 1040 or tax transcript, there won't be one to send in latter unless you file one now. You could save your self a lot of grief by filing even when you were not required to file.
