Hello All,

My wife and I have been in America for almost two years now and we are beginning to think about what to do next. We are definitely moving abroad but we aren't sure what exactly to do with our visa process here in the USA. We are wondering whether we should bother applying for the removal of conditional status to her current CR1 or not. We are planning a move to Korea for a couple of years but plan on coming back to America. Should we bother applying for the Permanent Resident and apply for a Reentry Permit? or should we reapply for a green card when we decide to move back? Any ideas would be greatly appreciated.

If you're planning on moving before the GC expires then don't waste time with ROC. Save money and just move overseas and return to card to the embassy when you arrive in the new country.

When you're ready to come back file the I-130 and the length of marriage will result in a 10 year card when she enters. Easy peasy.

Thanks for the reply. I have yet another question, though. What if we leave after the two year expiration date of the GC? Do you know if there is a 90 day extension or something?

also is there a problem with letting the GC expire? Do we need to tell USCIS that we are moving or something?

No, no 90 day extension.

You are better handing it in BEFORE it expires. This means she won't be put in removal proceedings and when you try and come back later it'll be heaps easier (removal proceedings can cause issues with bans and what not).

Most definitely leave, hand over the GC with a letter stating you are BOTH moving to XX together... don't just let it expire. This helps with stopping any red-flags with them thinking she moved without you or what not.
