Entering the US

While in the process of getting a k-3 visa, is my wife (from Canada) able to enter the US to visit me as long as she returns to Canada?

Or is she barred from the country until she has a visa since she married an American while in the US?

P.S. This site is great, Ive had a very hard time getting information from USCIS or any of their offices or 900 numbers, It seems like they just give you the run around. But the experiences on here are exactly what were all going through.

Sorry, I don't know much about the process in Canada. I have heard others on here say that they were able to cross over as long as they were able to provide evidence that they planned to return. If she chooses to disclose that she is married to a USC she may run into some problems at the border.

Once your I-130 has been filed she no long qualifies to visit the US without a Visa. There are people who have managed to cross the border without getting caught and there are people who have gotten denied entry at the border. If she is denied entry it can slow down the process of her coming to live with you. Good luck and best wishes.

This was covered a lot in the old forum. Many traveled to the USA with no problems when they were going through the Visa process. And of course there were some that were denied entry. It all seemed to depend on the POE officer. If he was having a bad day or not!! lol I travlled monthly to DC and never once had a problem. Was quick and painless. I brought evidence of ties to Canada with me (Leave pass, apartment lease, bill stubs) and never once was I asked to show them. When they ask you questions, answer them honestly, but don't add too much to it!! They would normally ask if I was here for business or pleasure, I would reply pleasure and would be returning on so and so a date. Don't bring tons of luggage with ya, dress nicely, and dont be nervous. And have a back up plan if you do get denied. If I wa sliving in Sweden or Australia, would I try?? Probably not, but being neighbors, why not. And as you know Canadians do not have to get a tourist visa to visit the USA, its al up to the POE officer. As previously mentioned, there have been people denied and it was brought up at the interview and it did not seem to harm there case. All depends on why one was denied of course. Thats my experience though, and if I had to do it again, i would. best of luck.

I do know of several people who were denied entry at Windsor/Detroit, so if that was your intended POE, you might pick another and have a higher chance of not getting stopped.

This is factually incorrect. There is no bar from entering because an I-130 was filed.

It's a bit touch and go this topic. You can still enter the US but the chances of you being denied are much greater. This is simply for having a greater chance of 'immigrant intent'. You may get in, you may not. My advice is just don't give too much information, but don't lie of course! Good luck.

Im planning to do the same thing, so I called the US Embassy in London yesterday, and they told me that citizens from some countries require an entry visa during the K3 process, however, in the case of many western countries, no visa is required, although they mentioned it was likely I would have to provide some form of confirmation that I will be returning, to be allowed entry.
