Hi all,

I am an USC filling I-130 for my wife. Need your help in answering question#14. My wife first came to USA in student F1 visa and couple of years back changed to H1B visa and is currently working. However, after getting her H1B, she didn't get a chance to go to her country and get her passport stamped with H1B visa. So, her passport still has her old F1 visa and her last I94.

Now for question# 14 in I-130,

1. What should I answer for "He or she arrived as a"? Should I put student F1 as that is her first status when she first came to USA or H1B as that is her current status?

2. What should I answer for "Date arrived"? Her first date of entry into USA or her last I94 date arrived or her latest H1B I94 valid date?

It should correspond with her latest I-94 entry info because shes adjusting from that. Whatever proof she has of her H1B status is what she should be using. She couldn't be working based on a H1B visa and there's no proof. That's her current status.

03/25/2009 - Touched. EAD approval sent
03/27/2009 - EAD card received in the mail; applied for SS# immediately (office is across the street from my home)
04/02/2009 - Received SS# in the mail
04/29/2009 - Interviewed. I- 130 approved, I-485 pending IO's review
05/05/2009 - Received NOA2. Welcome letter for Permanent Residency. I-130 and I-485 approved 04/30/2009
05/08/2009 - Touched. I-485 approval letter sent
05/11/2009 - GC received in the mail. Expires 2019
05/11/2009 - Applied to remove restrictions on my SS Card
05/18/2009 - Received unrestricted SS card
10/13/2009 - My darling husband of 2 yrs 5 months 3 weeks 3 days passed away :(
