what is the best route for Non US married to US citizen

Ok here is what I would like to know and please only reply if you know for sure I have received a lot of conflicting answers in the past and only confuses the issues.

I am currently in the USA on a vistors visa and I also live in Canada I have been married to my US citizen wife for a year and a half and now want to start the immigration process I have been told that while i'm in the USA on a visitor visa I can apply for a K3 what I need to know is what other forms will I need to

1) change my status

2) work in the USA

3) travel back and forth to Canada and the USA while my application is being processed( I have read that I wont need I129 advanced parole once I apply for a k3?)

please outline the correct forms and order in your reply thanks for any help

06/24/2012 received hard copies NOA for all

07/13/2012 applied for expedite I131 over phone

07/16/2012 received email notifying me of expedite received

07/16/2012 received bio letter appt 08/09/2012

07/17/2012 tried to do bio walkin at san jose(denied)

07/17/2012 did bio walkin in oakland success

07/23/2012 received email/text notice that my I765 was approved card is in production

07/23/2012 received email/text notice that my I131 was approved and mailed out

07/26/2012 received another text saying my I765 was approved card is in production

07/26/2012 received 3rd email/text saying my I765 was approved card is in production

07/27/2012 received email/text saying card mailed to address on file

07/27/2012 received email/text saying usps picked up mailed with my card to be delivered within 7 days

07/31/2012 received ead/ap card in mail

07/31/2012 received mail/text saying letter with appointment date aug 30,2012 mailed out

08/02/2012 received letter in mail today for interview aug 30,2012

08/30/2012 APPROVED waiting for card

09/08/2012 GREENCARD IN HAND YEAH(84 for days from mail in day)

The only legal way to go is CR-1 visa. This visa will allow you to immigrate to the USA. The process takes about 10-12 month. You can travel while your visa is being processed, however be aware that you will require to show a strong ties back in Canada in order to gain visitor entry into the US.

I was told that I could apply while I stayed in the USA which apparentlly is not legal but was also told that it wouldnt be denied either, and then apply for an change in status from visitor and an I129 advance parole. this was right from the office for USA immigration..there must be a lot of people on here that has gone this route...I also have a residence in Canada that I will be going to once a month.thats why I need a travel permit

You'll be "told" a lot of things in your life by people who have limited information. Visas are used to enter countries. You're already here. Since you are here legally now, (probably on a Canada visitor privilege instead of an actual visa) you are eligible to simply adjust your status to permanent resident. Follow the AOS from visitor and other visas guide. Beware that if you leave the USA before you at least obtain advance parole, you will not get back in, your AOS will be abandoned and you'll need to take the spouse visa route. So, if you can stay for at least 3 or 4 months after filing, you should be OK. If you need to leave soon, then AOS is not for you.

Take the above to the bank and ignore those who either simply don't know or are jealous (like me) because this method was not available to them. crying.gif

Facts are cheap...knowing how to use them is precious...

and if I want to work here what is that form?

You'll be "told" a lot of things in your life by people who have limited information. Visas are used to enter countries. You're already here. Since you are here legally now, (probably on a Canada visitor privilege instead of an actual visa) you are eligible to simply adjust your status to permanent resident. Follow the AOS from visitor and other visas guide. Beware that if you leave the USA before you at least obtain advance parole, you will not get back in, your AOS will be abandoned and you'll need to take the spouse visa route. So, if you can stay for at least 3 or 4 months after filing, you should be OK. If you need to leave soon, then AOS is not for you.
