Hello All -

I'd like to get some information for a Friend of mine. He is a US Citizen since 1995. In 2002 He went overseas (Jamaica) and his old girlfriend pregnant. In January 2010 he filed a petition for his biological daughter when she was 7. The child was born while married to someone else(US Citizen) who he is still married to now. The CBRA/passport were not not requested following the birth Abroad. Does his daughter still have a claim to US Citizenship 10 years after..? Is a paternity test usually requested in CRBA cases or does the US Embassy just "accepted" the names on the foreign birth certificates? Are they likely to request one since he was married at the time of the birth and is still married. ??

Yes, she will always have a claim, it just gets more difficult when she becomes an adult. Considering the circumstances and the country, a DNA test is likely.
