Its fine . i don't think they check with IRS anyway

I will look through my duplicate packet when I get to OKC. I am almost certain I only mailed them 1040s. So sending return transcripts will do according to the I-864 instructions and VJ consensus. For my wife's tax docs, I will just attach a note declaring fling exemption.

Make sure for your wifes that you provide the evidence that she is exempt...by that I mean the instructions indicate you need to send along with the statement a citation of what 1040 instructions exempt her and then attach a copy of the applicable tax law (the pages from 1040 instructions indicating a person below such and such income level is exempt)

I read the I-864 instructions. Evidence is only required for anything other than income threshold. Pg. 8.

If you were not required to file a Federal income tax return under U.S. tax law because your income was too low' date=' attach a written explanation.[/b'] If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it.

I will attach it anyway, but it's not required for income.

Mike-- my wife only filed taxes in 2011 so that she could receive the Colorado Tax Benefit ($1,000) but didn't make enough to meet the income requirements. In '09 and 2010 she didn't file taxes because she didn't meet the income requirements-- we still sent in a written explanation of why (even though it wasn't required).

Personally, I am in the "better safe than sorry" category. I would just send the letter-- it is simple to do and requires about 10min of your time.

As for me-- I am still waiting on my "super busy" father-in-law to clear his schedule to get his RFE forms to me :bonk: ---

Biometrics tomorrow though.

Im preparing myself to go to a Dmv to try to renew my driver`s license as soon as possible... I`m driving with my license expired although my Internation license is still valid... But I heard that it doesn`t matter, once I get a Us Drivers license I could never go back to the International one... :(

So it basicaly means if I get stopped by the cops I`m in serious trouble... :ot2:

Im so anxious, today is the 10th business day and no NOA1 yet...

I`m driving with my license expired although my Internation license is still valid... But I heard that it doesn`t matter, once I get a Us Drivers license I could never go back to the International one... :(

I don't know about this-- it varies from state to state, but once you have been residing in a state for more than 30 days then the DMV considers you a resident and therefore you must obtain a state license. In some states you can use it for up to 12 months--- regardless of if it is still in-date.

I would check with you local DMV website-- but if you have been driving on it for more than 12 months and have been living here z, then you have probably already been driving without a valid license.

I know this for a fact-- because unfortunately I got pulled over in Colorado some years back and was ticketed for driving with expired tags and driving without a valid license-- even though my UK license was well within date.

Do note however the terminology-- there is a distinct different in driving without a *valid* license and driving with *no* license.

Aw that really sucks you couldn`t get you DL in Florida.... They really make our lives harder!

I know we sent everything on the same day, and its driving me nuts cos I didnt hear from them anymore... Im praying that Im gonna be able to renew my drivers license... And my case is so complicated...

I have an expired jersey license and now after receiving the NOA I`ll try to get a PA drivers license, cos its where I live with hubby now. I used to be an Au pair in Jersey, and my International Permit is gonna expire only in December and so is my brazilian driver`s license.

I just wanna be able to drive and don`t worry if a cop is gonna stop me and I dont know what might happen... Biggest problem is my hubby doesnt drive, and I have to do all the drive... :(

Chris, I am sending the letter explaining the issue. That is required. I just will not send "additional evidence" to support why because it's not required for that particular exemption. Maybe my comment was not very clear. I will be sending the letter written by my wife and return tax transcripts (2011,2010,2009 and 2008) for my joint sponsor. Doing that right after my biometrics appt. today morning. ;)
