We are at 62 days and no EAD!!! Am losing hope quickly!:(!! I think something is wrong! Oh maybe bc the rfe! Idk but I replied back ASAP and everything it's almost been a month since bio! Still no EAD or interview day! And some of you filed same day as me! We are so depressed! :(:crying:

The clock does stop once you receive an RFE, but don't worry! You will receive your EAD notification soon-- if there was something wrong, they would notify you so no need to stress out. Waiting is all a part of the process.

I do know what you are going through though, everyone (Texas Newbie, Skul Teacher, Jdh, MikeX, Kstrozyk & Wattle Tree) who filed around the same time as me have already received their interview notification and I am the only one left out of the late Feb/early March filers yet to receive one-- so I understand and share in your frustration, but this is just a waiting game and we must remain positive as well as take in some comfort knowing that each day that goes by, progress is being made on our cases. :)

Most people have their EAD in hand within 8-10 days. Mine took 6 days from the in production email to the mailed email, then another two days for the USPS to delIver it. So a total of 8 days for my EAD to arrive.

Yes you can leave and re enter using AP, provided you did not overstay or fall out of status prior to filling.

The letter says within 60 days. Meaning you could get a response in a 10 days or less or it could stretch out until day 60. There is no way to know. However, most simple RFE's don't take long to adjudicate.

so im trying to get stuff together for my interview and i realized when i filed they asked for hubbys birth certificate or naturalization certificate..He wasnt born here he became a citizen last year so he has his natralization certificate so i sent that. now on the interview letter it says they need his birth certificate AND petitioners evidence of citizenship...ugh hes from brazil so i dnt even know if he has his birth certificate and im pretty sure itll need to be translated as well. i called mother in law and see if she has it but has yet to get back to me on it..so worried!!!!

The worst thing that will happen is that that you will get an RFE at your interview which will give you more time to get the document and translation and that is even if it comes to that.

I certainly wouldn't worry, just attend the interview and if they ask you for it just explain that he doesn't have one-- perhaps if he has an old Brazilian passport you could offer that instead.

Day 13: 03/09/12: NOA1s received for Forms: I-130, I-485 & I-765. Biometrics letter also received and scheduled for March 27th.

Day 24: 03/20/12: Email notification for RFE.

Day 27: 03/23/12: Hardcopy RFE received in the mail.

The worst thing that will happen is that that you will get an RFE at your interview which will give you more time to get the document and translation and that is even if it comes to that.

I certainly wouldn't worry, just attend the interview and if they ask you for it just explain that he doesn't have one-- perhaps if he has an old Brazilian passport you could offer that instead.

the thing that gets me is that like i said he has a naturalization cert as well as us passport but i would HATE for them to be like oh ur denied or u have to reschedule. thats simply not in cards for me bc hubby is in military and he cant just simply take time off and now that hes able to it needs to go right besides uscis office is 5 hrs away :blink: im just so scared to not have something they need being that i almost had to reschedule bio bc i didnt have a correct copy of marriage cert. i dont need it to happen twice.. :crying: :crying: :crying: i did plenty of research i even called uscis and they werent helpful at all!! they said just do what the letter says..

Maybe if you can't obtain the birth certificate from your mother in law, try going to the Brazilian government website and see if you can get it from there. I'm from Chile, and chile has the option to do that, you can just print it out from their website. Idk I this will work the same for Brazil, but try to find out, and yes you definitely need to translate it, and be certified. I don't want to scare you but that's an important document. Hopefully I was helpful. Good luck with everything!

so im trying to get stuff together for my interview and i realized when i filed they asked for hubbys birth certificate or naturalization certificate..He wasnt born here he became a citizen last year so he has his natralization certificate so i sent that. now on the interview letter it says they need his birth certificate AND petitioners evidence of citizenship...ugh hes from brazil so i dnt even know if he has his birth certificate and im pretty sure itll need to be translated as well. i called mother in law and see if she has it but has yet to get back to me on it..so worried!!!!

If it is any consolation, I am in a similar situation. I do not have my Indian birth certificate as my birth was not registered as it was not compulsory according to Indian laws at that time. I sent in all kinds of secondary proof along with my application such as school records, a certificate from my consulate, notarized affidavits of birth from family elders and plenty of documents from India showing my date of birth. But I am stuck when it comes to getting a certificate of non-availability from my local government office in India saying my birth record is not available with them. According to the filing instructions, this has to go along with the other secondary proof but I am having a very tough time getting it done from India since a huge bribe was demanded from my brother in law when he went to get the certificate. I refused to pay the bribe and am exploring other options and hoping to have it done before the date of the interview, else I am planning to document all the efforts I took in getting that certificate and present that at the interview. I am being told this is allowed and that I need to demonstrate that I took all possible efforts to obtain the document. I am going through some extraordinarily tense days due to this. Keeping fingers crossed, though.

Day 46,May 05, 2012 : Received hard copy of interview notice

Day 56,May 16, 2012 : EAD/AP Production e-mail

Day 64,May 24, 2012 : EAD/AP Card in hand

Day 83,June 11,2012 : Interview. Approved same day. Card production email.
