This is my first post on this forum, so I apologize if this has already been discussed and I couldn't find the answer. Basically our situation is as follows. My fiance is Nicaraguan and has a history of minor drug use. He used to smoke marijuana and tried cocaine a couple of times. He is completely clean now and is not using any form of drug. However, during his medical exam, he was asked about drug use history, and he answered honestly all of the questions. Our visa interview is in a couple of weeks, I realize that there is nothing that we can do about this issue now, but I am wondering if anyone else has any experience with this. And do you know whether or not this will be a major issue if he is clean now. I understand the implications of having been involved in "criminal activity" since drug use is illegal in his country, but I don't know if this past alone could prevent him from obtaining the visa. Any insights or advice would be greatly appreciated!

I honestly have no clue if it's an issue, but I doubt it. Normally the "criminal activity" that gets a visa denied are situations where he was arrested or went to rehab. Unless his prior drug use had a negative effect on his medical exam it's probably not included in the report.

Criminal history is used for character assesments and Medical Exam is used for health assessments - to prevent the spread of disease in the U.S.

I wouldn't worry too much, lol, and they should be happy to know that he's a (painfully) honest guy. I would've lied!! :rofl:

People have also been put on a delayed issuance for 1 year because of use within the last 1 year prior to the interview.

Drug abuse makes an applicant ineligible for a visa, but "experimental" use can be forgiven, so it really depends on how much he was using and for how long. The panel physician has entered his answers on the medical forms and only the consular officer will make a decision.

The medical examination is not just for contagious diseases. They also look for evidence of present drug abuse and mental disorder causing harmful behavior (ie scarring). These are 2 conditions that would make someone ineligible. The doctor doesn't care about the criminal side, they care about the medical aspect.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

06/25/24: passport received

This is what I have heard. And that is why I'm looking for an idea about what circumstances lead to denial, whether it is very likely. We are talking about occasional recreational drug use. I'm sure that a lot of this will have to do with the consular interviewer, but I'd like to prepare myself if it's very unlikely for him to be issued the visa...

As I said, any comments, ideas, advice is welcome.

I'm especially anxious to hear if there is anyone who has had to deal with a similar situation. However, as the first comment points out, I imagine most folks would not be quite so honest if the use had stopped and there was no record/evidence of it whatsoever. I guess I'm just crossing my fingers that our interviewer will appreciate the honesty and see it as a part of the past that does not define who he is today. #######, I love the guy, just wonder if his openness will get us in trouble this time around...

He was right to tell the truth, lying about that would definitely be a material misrepresentation, so he made the right choice.

Maybe you can try to look in your local forum to see if anyone going through the same embassy had a similar story.

Update: The doctor called him back to do a drug test and has required that he be evaluated by a psychiatrist in 2 sessions....

Well, that's good then; right? After the drug test and the evaluation are done, you'll have accurate information to proceed.
