Hello,

I got conditions removed from my marriage base green card just few weeks back. But we don't want to continue this relation going forward. Relation which I entered in good faith and gave everything I was having, stopped my career path etc. I am feeling totally shattered and want to rush back to my parents outside US. It might can take me more than 6 months before I gather myself again or do some career oriented program and come back in US.

1. If I am outside US, can my husband still file for divorce and we can have the process completed. I have no problem if he really wants that ?. Which type we should go for if we really want this to get over soon.

2. I think I should really apply for re-entry permit but not sure what reason I should provide in "Purpose of Visit". I am not sure if I will be enrolling into any educational program there or just that I will need time to come out of this shock. Please advise as I don't want to loose my last hope of having GC ?

3. All this happening just after removal of GC conditions - can that be seen as doubt or fraud and can impact my re-entry permit application or applying for citizenship later on etc. ?

1. Yes, your husband can divorce you while you are outside of the US. It will take longer without your cooperation, but it can be done. Divorce options and rules depend on the state you and your husband reside in - google it.

2. Not sure - but you could apply for re-entry permit and request it to be sent to the embassy in your country. You do not have to wait for the re-entry permit in the US. You may have stay long enough to do biometrics again though. My re-entry permit showed up in the mail 3 months after application, but that was more than a year ago, timelines may be different now.

3. If you get divorced you will have to wait 5 years before you can apply for citizenship AND during your naturalization interview you may be questioned about your speedy divorce after ROC approval. Be ready with answers ;)

For re-entry permit your divorce is not an issue.

July'09 Check cashed.

Jan'10 10 year GC received.
