I am wondering if one can go to school once they get the EAD waiting for the Green Card -- K1 Visa.

Thanks

i asked the same questions a while ago. it seems that you cant. EAD is work permit. to get enrolled in the school you need the green card and a test named TOEFL. now that test has requirements too that can be found on their main website

My wife started a Masters degree program with a 50% private scholarship 5 days after arriving in the US on a K-1. She was enrolled before she arrived and started classes before we were married. Our K-2 son started 8th grade 2 days after his arrival.

There are no restrictions on getting an education imposed by the federal government. A K-1 needs nospecial permission to go to school of any type. There MAY be some restrictions imposed by states or individual schools, you just need to check on that for your situation and she will normally NOT be considered a "resident" for tuition purposes until she has been there for one year, but some states waive that requirement if she did not move there for the purpose of education

Some people think, because there are student visas, that one NEEDS a student visa or something to attend school. This is not true. A person not intending to immigrate but to be here for a long period to go to school needs a student visa to authorize their presence for that period of time. Being a student is simply the reason for the visa, not vice versa. The federal government does not regulate who goes to school, they regulate who is present in the US.

Not at all correct

The TOEFL is adminstered all over the world and is not required by all schools, though it is required by many. Alla and our older son took the TOEFL in Ukraine months before their arrival. Our older son ended up going for his undergrad and masters in Russia but now will be doing his doctorate here.

Alla only needed to show legal presence in the US AND a Social security number, the SSN was really only needed because she received a private grant of 50% of her tuition and that has to be reported to the IRS. Alla applied for her SSN 16 hours after her plane landed and had the number the next morning.

The TOEFL website will list the locations in foreign countries the test can be taken. Alla and Sergey took it in Kiev. I suggest you also take the GRE exam as some schools prefer that over TOEFL

You WILL need the green card to get any form of government gauranteed student LOANS, but you do not need a green card to go to school. You do NOT need a green card for private student aid.

Its OK, a lot of people who aren't sure just make things up. Alla had started her second semester here before she got a green card.

Check with your local colleges regarding education if you are interested. If I had seen your thread I would have answered based on knowledge and experience.

Immigration and education are completely and totally separate issues. Student visas are used to grant specific permission to remain for long periods of time (longer than visiting) for the purpose of education. As long as the visa or entry method you use allows you to stay long enough (a K-1 does) there is no restriction against going to school. It is even legal for illegal aliens to go to school! Some states even give them "resident" tuition!

In addition to getting information from VJ, which is a good source, there is a lot to be said for turning off the computer and going to your local college or university enrollment office and asking for a counselor (I actually did that before I ever heard of VJ or a K-1 visa) We started the process of getting Alla enrolled inschool before filing the peition for the visa. Good thing. Getting her education arranged was far more difficult than the visa and took longer.

Also do a forum search in addition to starting your own thread. How many responses did you get? From anyone that had a fiance/spouse in college? This topic comes up fairly often and I have responded to dozens of such threads, I missed yours, but there are lots of answers and experience out there.

If VJ is flawed it is no fault of the "site" There are a lot of people here who are in love and can only think of "being together" as fast as possible, who cares that you are adults with more important aspects of beginning a life together than a visa. How does all that get thrown out the window for the sake of "being together" ? They worry about what a "touch" means (nothing) and when they were "last updated" and what Igor's list says but do not care about education, finances, insurance, etc etc, the things that are with you every day for the rest of your life

Get on down to your local college or university. Community colleges usually do not require the TOEFL exam but may do a an English assessment of their own, if the person's English level is better than what ESL classes cover but not quite good enough for college, many community colleges offer basic English classes for low cost that can prepare someone for the TOEFL

For her practicum II, Alla actually taught the IEP (Intensive English Program) at her college, this course includes a TOEFL exam at the end of the semester

Personally in my case i needed a GC to start my program because we needed to obtain all kinds of clearances before we could start handling clients. I applied and was accepted before i got my GC but i needed my GC to actually start classes. :) Hope that helps. Goodluck!

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

Thank you, VJ! smile.png

It doesn't really. Your case and need for a green card were not immigration related but related to something else. Clearances. Whatever that means. Something particular to your case.

If, for example, one found it impossible to attend school without receiving Federal Student Aid (immigrants CAN receive this, it is not welfare) then you would also need a green card. Not to go to school, but to receive a LOAN.

The OPs question was "Can I go to school" the answer is YES. Anyone stating otherwise to an intending immigrant is misleading them and costing them time in adjusting to their new life.

Well I wasn't trying to mislead anyone, just stating my situation which was no GC= no school because it was needed. My program consists of doing hospital and school placements during the day and then taking classes at night so without the Gc and my teaching certificate, fbi, police and sex offender ckearance then we arent allowed to begin the program but i was accepted without it for as long as i can provide the things before the first day of class.

So it may depend on the program you want to get into as well? My next door neighbor is french studying nursing and she needed a GC to begin as well, she is K1 too. But she just dropped out coz she got pregnant.. anyway. Bottomline is talk to your school, let them know of your situation and see what they have to say. Sometimes its on their website too :)
