Okay so I finally got a response from my congressional office. They are simply good for nothing.

"The Vermont Service Center has responded to my inquiry with the following message:

This petition was received on March 8, 2012, and is pending review at the Vermont Service Center (VSC). VSC is currently processing this form type with a receive date of February 27, 2012 or earlier. You can find the current processing times posted on the www.uscis.gov website.

Immigration Services Officer / Congressional Unit

Unfortunately it appears that the Service Center has “retrogressed” on the I-129 F, meaning that the processing time they are currently reviewing has gone backwards. I know how eager you are about reuniting with your fiancé. I apologize that this is not the message you were hoping for. The Vermont Service will not transfer cases to the California Service Center unless there is a significant difference (such as years) between the dates, as it takes quite a bit of time to transfer files to the various centers. I deeply apologize that you must wait a few more moths for USCIS to review your fiancé’s file. Hopefully they will have a decision by December.

If you experience any future problems with this case, please do not hesitate to contact me. Once again, I regret that I do not have a more favorable response for you."

DECEMBER? Like seriously? Btw, my fiancé will be coming to Texas to join me whenever that is.

Nothing surprises me anymore with this. They can do whatever they want and we can do nothing about it.

Welcome!

Sometimes, you'll get a text, or an email. Sometimes, you won't. Sometimes, you'll get a letter. Sometimes, you won't. Hahaha ok I've lost it.

Have you checked the status of your case on the USCIS website? That's how we check, although sometimes, it never gets changed. You've got a lucky NoA1 date... not a 9. You'll probably be approved soon! :)

Ok I check the status ... nothing ... :bonk: I Have been to Nicaragua 4 time and planning my 5th should I send the copies of passport stamps now or wait for the RFE ... ?

What other forms of proof did you send for citizenship and meeting in person? If you sent birth certificate and other forms of proof, you should be fine.

If it were anyone else... lying to a congressman would put us in jail. But of course, VSC must be above the law, because they lie every single day! I honestly doubt our inquiries, requests, or anything ever reaches Vermont. They are isolated in their perfect white tower.

I wonder if this is the reason for the delay now at Vermont. I found it on an attorney's website.

"Vermont Service Center is making final efforts to adjudicate the remaining FY2013 H-1B cap petitions. Vermont Service Center expects to render decisions in all pending cases by the second week in October 2012. Decisions could be in the form of approvals, denials or requests for further evidence. Vermont Service Center estimates that there are 10,000 H-1B cap petitions still pending."

I'm tired of asking, but why someone doesn't send a few boxes of files via fedex overnight delivery to California for processing? H1 visa petitions? Oh because they paid a lot more money for non-citizens to come here and work? Those are more important than family based petitions?

If this is the true cause of the delay and if they really deal with it until the mid-October, then maybe they will speed up with the rest of the petitions..

I hope I did not double post this but here is another link I found. Interesting - attorneys got involved to speed it up at VSC. Maybe we should join together with this group - the AILA???

"September 5, 2012

An American Immigration Lawyers Association (AILA) liaison committee has expressed concern to USCIS regarding the significant delays in adjudicating cap-subject H-1B petitions. The liaison committee reports that USCIS understands AILA’s concerns and has made adjudication of these cases by October 1st a top priority by adding additional resources available. USCIS states that service centers are doing their best to adjudicate these cases as soon as possible. We are hoping that this is the case and employers will not be forced to upgrade to premium processing."

Wait a minute..... "Premium Processing"??? Is there a Speedy Lane for more money I don't know about? In any case, they are backed up with not just our petitions.... they are so FUBAR. It means we will feel the pain of this one. They will have priority, because they don't want those lawyers nosing around. We will take the back seat. No wonder they are so SLOW. IDIOTS!!!

Hahaha did you see this line on that link:

"AILA is reporting a deterioration in our relationship with the USCIS Service Centers. The Service Center’s informed our respective AILA liaison chairs that they will no longer meet with AILA in the same individual formats as we have experienced in previous years. This negative development has been reported to Director Mayorkas, who appeared to be surprised by it. The news took AILA aback as well.."

It seems USCIS is too good for them.
