Can you interrupt with the K-1 with a marriage?

I did read some place about someone who married a Romanian, then went to the US Embassy with some papers and manage to obtain a visa for her in 2 weeks'time.

yup.... that is how it happens, you go to the embassy with some papers, have your interview then in a few weeks you get the visa.....................

............ AFTER the petition is approved which takes upwards of 5-7 months.

You need to look at country specific forum and then think again. Lawyers are not in control of this process, immigration is. Every case is different. A lot of people here have been to the rodeo before, so you might want to pay attention. Good luck with whatever you choose

Hello,

If you have already filed for the fiance visa, stick with it. The spouse visa is no faster.

I have a friend from Colombia who has relatives who tried for a tourist visa, (to actually visit New york for New Year's celebration.) They were lawyers, had strong ties in Colombia, owned property, everything they are looking for in a tourist visa, but were still turned down. They are looking for strong ties to the person's home country. Remember, a tourist must return when the visa expires.

For the fiance visa, we also, have considered going ahead and getting married in Honduras, but we will need an I-601 for him to come to the U.S. We are in a stronger position if I keep my job here in Maryland and my property and connections with my doctors here. If we go ahead and marry and I move to Honduras, they will say 'what's the problem. You are already married.'

If they turn us down, we marry, and get to try again with the spouse visa. It gives us a second chance, just in case.

Hmmm ok the only reason we thought about this was because we heard from this lawyer that the best option is if I go to Colombia and marry there, and then she can actually file for a visa that would get her here in 2 weeks. She actually said tourist visa.

So that's a no go?

This week we're really excited to begin the process of seeing each other again and getting married.

My fiancee is in Colombia, while I'm here working in the U.S.

What I'm seeing is that the process takes about 5-8 months right?

My question is, if at some point within that timeframe while the visa is being processed if I can take some time off from my busy work schedule to go and visit her and marry here there. Would that speed anything up?

For example a lawyer in Chicago told us that if I were to marry her in Colombia than she could just go in and apply for a tourist visa or something like that?

We just want the fastest way to be together, just like everyone else :)

Not to kick you when you are down..but...it would be much more efficient to take $350+ out of your pocket and throw them out the window right now. You will save the anxiety and will kiss the $$ goodbye now.

Sorry hon, if you wanna be together, you'll have to wait like everybody else! There is no such thing as "fast" when it come to USCIS. NO matter which way you do it, there is still gonna be a lot of waiting involved, so I suggest you get used to that idea before you commit to one another as it is very very hard sometimes.

Maybe so, but remember, visa does NOT equal entrance into the US...

Everyone on here is exactly right. If you've already started the K1 process, you have to stick to it and see it through.

Yes, I was going to do the same thing and marry during the K1 process. Luckily I read on here and confirmed it with my attorney. It would stop the process in it's tracks and have to start all over again. We were bummed by knowing that, because we really wanted to get married asap. But we can wait.

Direct Consular Filing means everything, from the very beginning, is handled by the embassy, with no USCIS or NVC stage.

However:

- to be eligible for DCF, the USC had to prove (see below why I'm using the past tense) that they were a legal resident of the country where they filed, usually for more than 6 months.

- the rules were changed by USCIS on August 15, 2011 and DCF doesn't exist any longer in most countries nowadays, including Romania. So even when the USC resides with their spouse abroad, they have to go through the regular USCIS/NVC/embassy process.

So what may have been true in 2004 can't happen today.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number
