My Experience with Filing under 319(b)

Just wanted to post and detail my personal experience during this process. I did a lot of reading on here and any other site I could find with information regarding the process. My wife became a PR in May 2010. We just sent in the I-751 in February to remove conditions. We moved to Korea in January for my new job and will be here a minimum of two years. She is going back to do her bio appt for the ROC this month. So we went ahead and filed her N-400 under 319(b) since we qualify (hopefully, haha). That was sent in on March 1st so it should arrive this week to Phoenix. The waiting begins to see how this will go about. I requested to have the oath and interview in Hawaii. I did not check to see if they can do them in the same day at that office but I surely won't complain about 'having' to go there multiple times. :dance:

In the letter I stated we had filed for ROC and received the first NOA and that my wife would be returning to the US for her bio appt, whenever that may be. I did not include a copy of the letter as it is in the mail on the way to me here in Korea (Parents do the darnedest things!).

Here is a list of the documents we provided:

1.Filled N-400

2.Check for $595 N-400 Filing Fee

3.Two (2) Passport Photos

4.Two (2) FD-258 Fingerprint Cards

5.Copy of our Passports

6.Marriage Certificate

7.Birth Certificate (Original and Translation)

8.Copy of current alien registration card

9.Joint tax returns for 2009, 2010, 2011

10.Joint bank account statements

11.Employment offer letter from Spouse's employer for spouse

12.Employment letter from Spouse's employer for spouse

13.Employment Deployment Letter of Understanding (DLOU) from Spouse's employer for spouse

14.Copy of spouse’s (Spouse's employer) ID Card

15.SEC Filing Information (Form 10K) for Spouse's employer to establish they are an ‘American Firm or Corporation’ as requested in Immigration and Nationality Act (INA) Section 319(b)

16.Copy of current lease for apartment South Korea

We had her fingerprints done at the Yongsan Army base in Seoul. After multiple calls to the embassy I gave up and did it in 15 minutes at the Army base.

Our package was received by Phoenix on March 12. They sent an e-mail notification that it was being forwarded to the National Benefits Center. We received our NOA1 dated March 14 yesterday. Now we wait :whistle:

My package was received on the 12th in Nebraska and I've heard nothing, my check hasn't even been cashed, it's driving me crazy. So glad all is going well with you guys, good to see the 319(b) is going right for someone :)

We received our interview letter for June in Honolulu. So everything seems to be going fine. We did receive an I-751 interview letter as well for the same time and date. We filed both packets within a few weeks of each other so I'm thinking it's just a formality :unsure:
