I-134 Co-Sponsor Question

Hello all,

We have recieved our NOA2 acceptance a few days ago, and I wanted to start preparing documents needed to send over to my fiance in Montenegro in order for him to have everything he needs in preparing documents for the embassy and the interview.

I submitted my original I-129F petition with my lawyer and then she had me fill out the I-134, also with my father as the co-sponsor. (We submitted that on July 29, 2011 with the original I129 submission.)

What I am now wondering is in the guides it says after the NOA2 acceptance, "You will likely need at a minimum (for the above form) two to three of your most recent pay stubs and a signed letter from your employer listing you job title, start date, your salary, and the status (full-time) of your position."

Now, because I am the primary sponsor I am assuming I must gather MY recent pay stubs, the letter from employer, etc.

Am I correct on this? Or does the co-sponsor (my father) submit this information?

And also, I submit an I134 correct? NOT an I864.

I don't know why your lawyer had you submit an I-134 with the original petition since it isn't asked for. USCIS does nothing with it.

8+ months ago is ancient history. You'll want to fill out a new I-134 with recent information for the interview. Updated documentation to support what is on the I-134 (taxes, paystubs, etc) will also be needed from both you and your co-sponsor - unless you have no income or are using your co-sponsor's income entirely. If your interview date isn't in the next few weeks, the consulate will probably want to see 2011 tax returns or transcripts - or a reason why you weren't require to file.

Form I-864 is needed when adjusting status later, although some consulates do ask for it (a few in Asia, IIRC). Check your consulate website for their instructions or email them and ask to be sure. Odds are that you won't need it.

Well, my lawyer is an idiot. Sadly, I saw the forums of VJ AFTER my NOA2, SEVEN MONTHS TOO LATE.

I wish I would have known earlier, but then I was so anxious to start the process that I went with what the people in my community were telling me, "get a lawyer!"

Anyway...So I will be preparing my new I-134 this week, and I do have my 2011 taxes already done along with my fathers.

So to be clear - both my father and I have to have letters from our employers?

Yes, each of you fill out your own I-134 and provide the most recent year's tax transcript(or a complete copy of the return sent to the IRS including all forms and schedules plus any W-2s and/or 1099s), a letter from employer stating position and salary, and a few months worth of the most recent pay stubs. The co-sponsor also needs to provide proof of being a US citizen or permanent resident (copy of birth certificate or naturalization, or a copy of the bio page from their passport/ or copy of green card, front and back)

Sorry everyone,

Okay, so I am looking back at the packet of my entire I-129F that my lawyer sent in originally in July.

Turns out, we did not fill out I-134s, but "I-864 Affadavit of Support Under Section 213A of the Act".

She has it filled out here for me as the petitioner. Then, under part 2 my fiances information.

Then for part 6 she has nothing filled out. Only checked off the part that says emplyed as an...and there is nothing in that line.

Nothing in line 23, nothing 24..and so on.. until line 31 where I signed.

Then my father's I-864 is filled out with his information and him checked off as the only joint sponsor. His info in part 6 is filled out etc with his taxes.

NOW, why in the world did she have us fill out I-864s??

ANYWAY, that is over and done with... but now that I have to move on and submit paperwork after our NOA2...

I ONLY HAVE TO FILL OUT I-134s?

And now when I fill it out, do I fill it out fully with my information? I made very little money because I am a full time student almost graduating.

Ughhhh, what do I do???? Sorry, I am so frustrated with this. Especially knowing that my lawyer did not do a good job. But I am thanking God for the approval. Now I want to make sure I do the next steps correctly!

I'm sure the consulate will specify which affidavit they want when your fiance gets packet 3, but if you'd like to confirm in advance you can email them at BelgradeIV@state.gov. I'm fairly sure they'll say they want the I-134. You should also confirm whether they'll accept a joint sponsor, but I suspect they will.

On your I-134 just fill in section 7 saying you're a student, and put zeros in the income and asset boxes. The CO won't really care what you write there if you've got a joint sponsor.

The IV unit at the embassy in Belgrade doesn't give much information. Most consulates require an I-134 for a K visa, though.

I'm sure the consulate will specify which affidavit they want when your fiance gets packet 3, but if you'd like to confirm in advance you can email them at BelgradeIV@state.gov.
