Hi! I have already applied for AOS but the wait time is about 4 months. I want to apply for i-131 but am unsure of how to go about. Will this give me permission to travel before i receive my GC how long is the ait time for a decision on this application. Is it even worth it. I need to travel back to my home country to take care of something but need to be assured that i will be able to re enter withoutany problems....please help!

Not a spousal process question - moving to the AOS forums.

the 131 should have been filed at the same time as the AOS package was. 131 AP document can take 2-3 months to be approved.

You will need to have your NOA1 from your AOS to file the 131 AP document without cost.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Depends if your travel needs are really urgent or not. If you really must travel soon then you should file it.

What process? Are you filing for the K-1 visa? If so, have you received it yet?

Once you receive the K-1 visa (after interview) and enter the U.S. you have to get married within 90 days. Once you get married you can then file for the Green Card, Work Authorization, and Travel Document (I-131) together for one joint price.

The I-131 is optional but its worth it if you chose to leave the country before receiving the Green Card. This is all part of the Adjustment of Status (AOS) process which comes after the K-1 process.

I sent my aos application the 1st week of feb. i received an rfe and will send it out monday. The thing is that i need to travel end of april early may. So i looked into i-131 just now. Should i apply for it or just wait. I dont know what to do.this waiting is very stressful.

I already had my biometrics done

Well even if you file a 131 right now ( Monday with your RFE papers ) It probably wont be granted by the time you need it anyways. Its your choice on what you need to do. You can try filing the 131 and see if you can get it in time or you can just wait 4-5 months for the green card and travel another time.

You cant leave without the green card or AP because you will not be allowed back into the USA and your AOS status will be abandoned.
