Good Morning,

My wife got her U.S. Citizenship thru our marriage, I am a U.S. citizen. We want to file for her brother along with his wife and son to come to the U.S. and live here with us. I read thru the guide and procedures, but they seem very simple and I just want to make sure that I understand everything clearly and make sure I don't miss anything.

I will submit the form I-130 with the following:

A copy of my wife's proof of U.S. citizenship

A copy of my wife's Birth Certificate (Is translation still required?)

A copy of my wife's brother's Birth Certificate (Translation if required?

A copy of our Marriage Certificate showing her marriage to me and why her last name has changed.

Do I need to include her brothers marriage certificate and birth certificate of his son at this time?

I am assuming by filling out #17 on form I-130 with the information about his wife and son that they will be included in this petition? From what I understand is that I submit the above and sit back and wait for about 10 years? Could someone please give me a quick guide to how this process will work? What will my wife and her brother including his wife and son have to submit in the future?

Your wife is petitioning, not you. She is the sibling of your BIL.

she doesn't need any marriage certificate, she is filing for her brother. there is a place on the i130 to write her married name and her maiden name.

the wait is over 10 years.

Hey Mike,

Your title is going to create confusion because people will think they can petition their in-laws. Just to clarify, you are not petitioning anyone. It is your US citizen wife who is petitioning her brother.

You do not need to include the brother's marriage certificate or birth certificates for his family. What you have listed is fine.

The wife and son are included in the petition as derivative beneficiaries. It takes about 10-12 years for a US citizen to petition a brother. If the son turns 21 during the wait, he may not be able to immigrate with his parents. At this time, there is no way for certain to know if the son can immigrate or not. How old is he?

Don't worry about the documents in the future, they have a long wait. As long as they have official copies of their birth certificates and marriage certificate; it's good. The documents they will need in the future are medical exam , police certificates, and passports. The medical exam and police certificates expire within a year, so they get these when they are ready to interview in 10 years. Passports expires, so they don't need them now.

Essentially, your wife will file the I-130. In a couple of months, she will get an I-797 Notice of Action (aka NOA1). In a few years, she will get a NOA2 telling her the I-130 was approved. She does nothing after submitting the I-130 for the next 10 years.

I am sorry for the confusion about the topic. I ckearly didn't think the wording thru to clearly.

I understand that I am not petitioning. I will be helping her fill out the forms and making sure everything is submitted.

Quick question on this same topic as my husband will be going through same process. There is no need of G-325A forms when filing I-130? If there is a need of G-325A, is it needed for beneficiary as well as derivative beneficiaries?
