Operator didn't say anything inappropriate. Yes you do need our opinion. You asked for help and we are giving it to you. If you commit fraud, you'll be back here asking for help as to stop deportation procedures. So, just listen, take notes and do the right thing.

Don't ever do anything you're not willing to explain the paramedics.

hi all please i need your help

My fiance in US and i will be in US with a valid tourist Visa and we will get marry in US so i want to know what is the procedure that i should do to stay with here because she don't want me to back to Egypt.

Doesn't OP "marry or not" have to leave before the legal Visitor Visa expires???

Then they would file Spousal visa and wait like the rest of us. Right? :whistle:

Since they have intent, yes. They can either:

a) come on the tourist visa, get married, file for the CR-1, and stay in the US as long as their visa allows BUT return before their stay expires and complete the process abroad

or

b) apply for a K-1 visa and use that to enter the country instead, then stay and adjust status.

AOSing from a tourist visa is not an option for the OP because they have intent, not an unexpected change in circumstances. If they called USCIS and were told it was okay to do so, it's probably because call center employees, NOT immigration officers, staff the USCIS 1-800 number.

Don't do it! Your Fiance needs to file petition (i-130) on your behalf, then you need to got to US Consulate (with the appropriate paper work) and apply for a K1 Fiance Visa. Don't come to the States on tourist visa and get married. That is considered fraud.

I actually visited my fiance in the US before we got married. We really wanted to elope, because we just wanted to be together. But, we wisely went into the the INS (now it's called USCIS) and asked what we should do. They informed us that if I got married on a tourist visa I could be deported and denied entry for xx number of years. So, I returned to Australia and 5 months later I was back in USA with my K1 Visa, getting married to the love of my life. Much less dramatic and painful than trying to skirt the system.

I-129F filed May 1996
K-1 issued August 1996
Married in September 1996.
AOS October 1996
LPR April 1997 to 2003.
Forced to abandon status at POE in DC, 2003.
Lived & worked in Asia together 2000 to 2011.
We have 2 gorgeous kids!
Returned to USA Oct 2011, on B1 tourist visa
Filed i-130 and i-485 in April 2012.

LPR approved 10/22/2012 (Conditional 2 year period waived)

Fast forward 4 years to 2016.... it's that time!

Day 0: April 13, 2016 Sent N-400 at 12:20pm :dancing:

Day 1: April 14, 2016 Delivered to USCIS Lewisville, TX 11:38am

Day 6: April 19, 2016 Text acceptance 3:48pm ; Check Cashed

Day 10: April 23, 2016 NOA received

Day 16: April 29, 2016 NOA - Biometrics appointment scheduled

-For a K1 visa, the petitioner needs needs to file Form I-129F.

-The OP may come to the United States on the tourist visa and get married, that is perfectly legal. However, what is fraud and misrepresentation is entering the U.S. with said visa with the *intent* of then adjusting status to that of a Permanent Resident.

Marry by all means, but return home and have your spouse file the appropriate petition on your behalf.

The K3 is largely obsolete these days since the processing times are no longer taking several years.

You main options are:

1) Get married and have your spouse file Form I-130 (plus all other documentation) on your behalf. Which country you marry in makes zero difference to the process.

2) Have your fiancee file Form I-129F ASAP and then wait out the K1 process.

Both options take about the same amount of time, really just need to decide weather you want to spend that time as a married or engaged couple.

I highly recommend the K-1 visa. My experience was satisfactory. We'll get married tomorrow here in NYC.

Are you still in Egypt?

Do you have a tourist visa already?

If you interviewed did you tell them you have a girlfriend or fiance in USA?

When you fly to USA will you tell the Immigraion people that you have a girlfriend or fiance in USA?

If you do not have a tourist visa yet and you interview and you tell them you have an american girlfriend you will not get a tourist visa

If you lie to immigration in the interview or off the airplane...it is immigraton fraud and you can get a lifetime ban from USA

So, if you lie to the immigration in the USA and say you are on vacation. and you get married 2 weeks later---Is INS ever going to believe you came here and fell in love and got married??? I would not

People have done this successfully. The important thing to remember is IF YOU LIE TO USA GOVERNMENT YOU CAN GET A LIFETIME BAN. That means you will never be allowed to stay in the USA. They will remove you at some point. And you will never be allowed back to USA.

If it is true love-then she can wait another year to have you next to her.

Good luck

Plus, if you come to USA on a K1 fiance visa you will be able to work in 3-6 months (depends on when you get married)

If you come here as a tourist and then apply for AOS...... AOS can take many months....

If you get married in Egypt and apply for CR1 spouse visa--you can work within a couple weeks in the USA.

In terms of the CR-1 vs the K-1 it is entirely up to you. The processing times are similar. With a CR-1, the overall cost of filing is less and you enter the US as an LPR so no need to adjust, you can work immediately, etc. But if getting married immediately isn't possible then the K-1 is a good option. Do not bother with the K-3, it's pretty much dead.
