Hoping for some advice on this please.

Got an RFE - see attachment. I entered the States on December 29 through the VWP is all they want a copy of my passport stamp?

Is option 2 for people who entered the country illegally?

Looking back, I didn't send them anything apart from a copy of my photo page

Do you have a print-out of your ESTA? If so, submit that as well, and the admittance stamp from when you first entered.

You just need the copy of the stamp. The ESTA shows you applied, not that you entered legally. If you have the stamp, you're all set.

The stamp is on a page just by itself, do I need to submit anything else to show that the stamp came from my passport?

I don't see how you could show that with photocopies. You will bring the original passport to your interview, and if there is any question, the IO can inspect the passport.

Timeline

I concur with Harpa Timsah. VWP travelers do not receive an I-94W any more (the green tag that was stapled to the passport), this has now been replaced by the ESTA application. The USCIS wants you to show evidence that you entered the country after an inspection by an IO at the POE. Had you entered illegally, by swimming the river or jumping the fence, then you would not be allowed to adjust your status, not even based on marriage. The stamp on your passport will show that an IO did check you and let you in, i.e. that you entered legally. Send them a copy of your passport page where the admission stamp was placed, that's what they want. Good luck.

Hi all

I sent off the documents as discussed above and it is showing online that they received them on March 7 and that I am now at 'request for evidence response review period'. Any idea how long this normally takes, 5 days seems a long time if all they wanted was the a copy of the stamp?

Hi all

Yup, but they do follow the routine so it could take up to 60 days, it is usually way sooner so be patient. And good luck.
