trying to avoid the wait after denial

Timeline

After recieveing a 221(g) at the interveiw for our k1 visa our case was sent back and we had got married since than. So now i want to know if I can just send in the petition for the cr1 visa now while i wait for the NOID/NOiR? I would still respond to the NOID. Has anyone done this b4?

Your K1 will more than likely expire, if it hasnt already.....You may receive notice of this or not, some do most dont...You will not receive a NOIR for this since it does expire. But you need to know the reasons why they sent it back and be able to address them, if it was just questions not answered correctly or what. You can go ahead and file your new petition CR1 and be fine. Again 99% of the K1 expire and have not been given an extension, which would have come from Casa. But do try to find out why it was sent back and address those issues. Hope this helps.

They won't tell you. I think you need to call to at least find out what is going on with the K1. It's probably expired, but it is best to find out for sure. The notice will just say "your petition has expired, and you are free to refile." You could file a FOIA (freedom of information act) to get the consular notes. I don't know much about that process because we didn't do that, I just know that it exists.
