Hi All,

I recently file for AOS. I got all the NOAs and day after I got ASC appointment notice.

Today, I got an RFE on my 485. Evidence of lawful admission into the United State??? I came here as an F-1 student with multiple entry visa and my last entry was in January of 1994.

The sad thing, my passport and other personal stuff were stolen and I reported it to the police and obtained a copy of the police report.

So last year, I filed a I-102 for replacement I-94 paid $330 and explain the situation with a copy of the police report and I got a notice that they could not find me on their system, and that I had to provide a proof like a photocopy of my I-94. For the love of GOD, I don't have a copy. How is possible that you can't find me. Paying $330 was a waste of time and money.

The interesting thing is that with the RFE, they have attached supplemental A to form 485 which I read and don't think that I'm eligible.

Any suggestion to how I should proceed at this point?

it's not that you are elegible, but to adjust in country, or you file the petition with proof that your last entry to the contry was under a valid visa and proof of last entry. or you are ajusting status under the 245i law, which you would need to have filed the i485A together with the i485 and have proof.

For Supplement A, I believe they want that if you can't prove you were inspected when you arrived to the US, you have to check C for Part B.2. You can schedule an InfoPass or call and talk to a tier 2 employee to verify the situation. Good luck.

The OP cannot do Supplement A. The window for that passed long ago. Ignore.

OP - The onus is on you to prove that you entered legally. Finding 18-year old proof is going to be tricky though. Police report is a good start. Anything from your school then? Old I-20s or something? Can you contact the school, maybe they have a copy of something. Maybe someone else has more ideas. Good luck.

I was able to login to my old school and print the screen with my name on it. I don't have a copy of my old i-20s because it was stolen with the bag where all my paper work was in included. I plan to include all the aforementioned documents in my response to the RFE. More importantly I have to go to the local USCIS office and ask question

btw: What's an OP? There are too many acronyms here and I can't keep track :)

Most colleges/universities tend to have copies of I-20. I will advise you to contact the DSO (designated school officer for foreign student)

Day 0 - 03/31/2012 - Package (concurrent I-{130/AOS/AP/EAD} ) sent to Chicago with USPS
Day 1 - 04/02/2012 - Delivered!!!
Day 5 - 04/06/2012 - "Acceptance confirmation received for entire forms & routed to NBC" was sent via email.
Day 10 - 04/11/2012 - NOA for I-{130/AOS/AP/EAD} Received.
Day 15 - 04/16/2012 - NOA for Biometrics appointment Received. {Scheduled for 05/08/12}
Day 37 - 05/08/2012 - Biometrics app completed.
Day 44 - 05/15/2012 - Interview date schedule @ Dallas/Irving TX..
Day 54 - 05/25/2012 - EAD/AP production Notification.
Day 75 - 06/15/2012 - Interview'd with NO approval. 1 hr Post-interview: Received I-485/Card production email.
Day 78 - 06/18/2012 - 2nd emails {I-485/Decision/Register PR and I-130/Post-Decision} Received.
Day 81 - 06/21/2012 - Received {email of Card mailed out} and 2 Hardcopies {I-485 & I-131 approval}
Day 83 - 06/23/2012 - GC touched down. 10x Mailman.
