New Medical Requirement for AOS in 2012??

Good catch. :thumbs: Wasn't thinking of that as I typed it.

Hehe..no problem. I just know because I was trying to have the least amount of needles possible since I'm big baby when it comes to needles lol. Was not impressed when they told me I had to have the flu shot for my medical last April (meaning I needed a total of four vaccinations!!!). If I'd known that at the time - I would have had the medical earlier lol ;)

Key words here from the nurse is she said, "As of 2012, the USCIS have changed their rules", so I wanted to share this information.

No new rules for 2012 but a new form I-693 that is poorly designed. Read the instructions for new form I-693, p.4 (if I remember correctly) and it will tell you that the K1 medical is good for 12 months.

Your RFE could be because your medical results may have been lost. If they don't match up what you turned in at POE to your AOS application, then they can't approve you, even if you send a photocopy of the DS-3025. The one they need to see is the original in your file. And you also won't be cleared of all medical conditions if your file is lost.

Another possible RFE. New I-693 (just like the previous) says:

If the vaccination record (DS-3025) was not properly completed and included as part of the original overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon.

So yours doesn't look "properly completed" to me and could be rejected. Not saying it won't be forgiven but there are small oversights by the panel physician that an adjudicator could zero in on if he's a stickler.

Varicella line- needs VH written in column 6 instead of checkmark. If you had a lab test to check immunity, then a date goes in that box. He just wrote immune by the shot.

I wonder why I was only given the 'TD' shot and not the 'TDAP' shot?

I wonder what that's all about? I have no clue what any of it means either :bonk: :bonk:

Tdap includes Tetanus, Diptheria, acellular Pertussis (not Polio). You need T and d within the last 10 years to pass AOS.

Pertussis is a once in a lifetime shot, so if you had it (you did) as a baby, then a Td gets you past AOS. If you didn't have proof of DTP (baby version) then you might be given Tdap to cover the pertussis requirement.

The capital letters I used medically mean big doses of vaccine and lowercase letters mean smaller doses. Studies have shown some adverse reactions to D and P when given to adults, so the d and p mix like Boostrix were developed for adults. USCIS will accept Td or Tdap or DT or DTP or DtaP.

I still don't understand why though if the TDAP was required for K-1 visa's why I didn't get it done last June when I did my medical with the panel physician, so weird!

Actually zero shots are required for a K1 visa. Australia my have a local preference that you get them since you will need them shortly for AOS, however immigration law does not mandate shot requirements for K1 non-immigrant visas.

I agree with Nich-Nick that the panel physician didn't do what they were supposed to. It says "If immune write date of test" and he wrote immune but no date of test. Unfortunately I do believe he's done wrong. That said, $95 for your shots and whatever is pretty cheap really. You must have your baby records so take that AND your DS-3025 to the CS (if this is what the RFE is for). USCIS still might be okay with it because you DID have all the fields completed (even though he didn't specify which ones they were for each section is complete. You *might* be okay.

- you didn't include tax returns for your wife OR if she wasn't required to file, letters stating why she wasn't required to file.

- you didn't include evidence of your FIL's citizenship/LPR status.

- you included tax returns for your FIL and sometimes these can be missing info which is why IRS transcripts are preferred.

- I assume you mean marriage CERTIFICATE as the licence is just permission to marry, it's not proof you did.

Just wanted to point out this may not be entirely correct. I'm not sure what the situation is in the OP's state, but I know for a fact that the county/state (Harris County TX) where I was married does not issue CERTIFICATES. Once married the License is endorsed by the officiant and filed with the county clerk's office, and it then becomes the only proof of marriage that is issued.

I had problems trying to prove this to the NVC as they wanted a certificate too.

The licence is turned INTO the certificate in those situations usually. Basically photocopies the licence onto the marriage cert paper, registrar does his thing, stamps it and it's done.

I married in the county south of you so have the same TX marriage requirements. The endorsement and county seal showing it was recorded in the county vital records is what makes it the certificate...it had been certified by the county clerk.(certified.... certificate??) Did you get it done that way? Had you not taken it back to the county, it would have been a license that was void after 30 days. Surprised NVC didn't "get it". What a bother.

Hey guys, wow, thanks for all the replies, let me try and answer them.

1. Marriage Licence/Certificate; Yes sorry it is the certificate. Weird though, at the top it says 'Marriage Licence', then underneath about a third of the way down it says 'Marriage Certificate'. The comments are correct, here in Montana, we applied for a marriage licence, then once we got married and had it all filled in by us, the pastor who married us and witnesses, we then took it back to county records and they stamped it and whatnot will all there official seal, so yes the document actually says both 'Marriage License' and 'Marriage Certificate', so it's both.. yeah it was definitely certified, sealed with the official stamp by the county clerk official.

2. In the affidavit of support cover page I wrote an extensive two paragraph explanation of why my wife doesn't meet poverty and why she doesn't need to file a tax return (ie her income is $0), I hope that covers that.

3. Proof of citizenship for my father in law.. interesting, he is a Citizen by birth (aren't some people so lucky hehe :whistle: ) so what would a copy of his birth certificate do the job? How else does he prove his citizenship? Interesting though, that never even crossed my mind..

4. Since I sent off the application I did go ahead and order the tax transcripts and I have received my father in law's three most recent IRS tax return statements, I have them ready to go.. I didn't want to wait, for my own peace of mind I wanted it all in before my I-94 expired, I did read that Federal Tax Returns and W2's are usually okay although IRS statements are preffered so I opted just to 'risk' it, so to speak.

5. #######! Baby vaccination records, my mum has those back in Australia.. I'll hope that's not the issue or just get them again.

6. I'm kinda annoyed then that the panel physician didn't fill it in correctly, especially after paying $740 for the thing, it's weird how you just trust that they filled those bits in correctly..

Honestly part of me is just hoping the RFE is medical related, I mean I have the appointment booked in and hey $95 plus shots, meh, whatever, I can get that done.. then again, it would be 'great' if I just forgot to sign a form.. but sadly I'm pretty sure I did, I checked over it 4 times, my wife 2 times, and my brother in law once too.. not saying it couldn't be overlooked, but yeah.. I'm not worried too much at the moment, I get that icky feeling as I'm sure you all probably have gotten with RFE's, just the 'I just want it to be done' feeling, but hey, it's all good! :D :D Time will tell, it's been three days since RFE, so hopefully I might get it in the mail tomorrow.
