Guys,

I'm looking at the OPTIN mail thingy.

I understand it's a way to communicate with the NVC electronically instead of snail mail, but is this still for Montreal and Guangzhou only? Has things evolved so Europeans can use the system and if so, how do i proceed from here on?

I've read the guides, but I don't know if I can use this system.

I've sent in in the 3032 by e-mail and received the fee bill invoice by e-mail

So my current social security has stamped on the front "VALID FOR WORK ONLY WITH DHS AUTHORIZATION". Should I request for them to send me a new card on the form(not new number but just a new card wihtout that info stamped on the front)????????

I was also previously an exchange visitor on a J1 visa. I included the social security number on the forms and also checked the box for a card to be issued. My forms have been accepted so far and it should mean you will get a proper card after POE rather than the paper one you have now :).

Oh, and make sure you include a copy of the form DS-2019 (IAP-66) that went along with J1 visa. That's what my RFE was for as I didn't know that they needed it. It is to do with the 2 year residence requirement after having an exchange visitor visa.

Timeline

First everyone needs to quit comparing the K-1s to CR-1s. Total different ball game. K-1 and K-3 (mostly defunct) are non-immigrant visas. Yes, they get an approval a little quicker, yes, they get through NVC in a few days, yes, they seem to get interviews faster. Once they get here, they have three to five months more wait for their green card. Their visas are substantially more than a CR-1. CR-1's POE, have their temporary green card in their passport, get a SSN in a few days and are ready to take on their new life.

K-1 and K-3ers still live in limbo, even after everything. If they don't have their ducks in a row and have all the evidence and the I-864, it's all for nothing. They can't get a job, they can't volunteer, they can't get a driver's license in most states.. it's sit around and wait, wait, wait. Just like all of us are doing now, the only perk, they get to spend it with their significant other. How much fun would that be after six months of sitting on the couch watching the world go by. There's a reason money and jobs were invented, so you can spend 8 hours a day away from each other!

The big, bad US government isn't out to get anyone. Yes, it's a good joke of mine, but I don't think anyone employed by Uncle Sam is monitoring what I do or when I do it. When you send in that I-130 it's a ####### shoot. You go to one of two service centers. California being notoriously slow, or Vermont being faster. You don't know where you'll end up! Once there, you don't know who's desk you're going to end up on.

Suzy Q. might not be as fast at hammering out petitions as Johnny B. Or Suzy Q. has a lot of petitions from high fraud countries that take extensive work, you might be at the bottom of the pile. Johnny B. might not be even reading anything and just rubber stamping stuff as it goes through. Everyone has heard the stories about getting to the Embassy/Consulate and being denied because of something USCIS should have caught. Or even being denied at POE because everyone dropped the ball. Hell, our petition was LOST! I have no doubt we would still be in California in a USCIS black hole if it wasn't for my congressman lighting a fire under their butts. The US Government is highly inefficient, but not out to ruin someone's life just for the kicks of it.

There's probably been dozens of people over the years on VJ making spread sheets and mining data, crunching numbers to figure the system out. No one's been able to crack the holy immigration code.

Maybe some Embassies/Consulates really do stick to the first two weeks of the month rule, maybe not. Maybe there's thousands of other people all around the US and the world going through the same thing, and they have to have an appointment too... It's not just us. You have the CR-1s and IR-1s and K-1s and K-3s and HB-1s and F-1s... the list goes on. There's been people waiting for decades, years!

Ya, it's no damn fun to sit here and watch people with NOA1/NOA2/NVC dates before ours zip through the system and be with their spouses and come and tell us how grand life is. It's all sunshine and cupcakes and sprinkles! Wish you were here! It made me mad, jealous and down right pissed off when I was watching people from September go to interviews while we sat in CSC. In a perfect world it would be first come, first serve, here's your visa, have a nice day. Unfortunately we're not living in a perfect world.

Knowing what I know now I would have probably gone with the K-1/K-2 visa route for my wife and step-child. Back in March 2011 when my wife's divorce was finalized I started consulting an immigration attorney who was the cousin of my friend's wife. I asked for his advice on which route to take and he suggested the CR-1/CR-2 route. His logic was that if we got married in Chile we could file directly at the consulate in Santiago. This sounded like a good idea. Unfortunately I didn't do my own research into DCF until June. I was already married to my wife at this point and I only found out about it because I was checking the Embassy website to make sure we had all the required documentation. That is when I read that in order to be eligible for DCF you had to be residing legally in Chile for the past 6 months or more. It was at this point that I discovered Visajourney and began reading through the guides and forums.

I decided to wait and file the I-130 petitions once I was back in the US (early July) but for whatever reason I waited until the end of July to actually ship everything off. This proved to be a big mistake because as many of you know July 2011 filers were lucky if they got approved in 6 months. The 5 month mark landed in December when it seems like the entire USCIS staff takes the month off and nothing happens.

I understand the downsides to K-1 visas, but I would rather be with my wife now even if she couldn't work or drive. But, I can't go back in time and change that. At least the NVC process has been painless up to this point and if our luck continues we should have case closed by Tuesday or Wednesday of next week and then a week after that know the interview date.

07/28/11 - NOA1 for both

02/21/12 - RFE for both (received hardcopy on 2/25)

02/28/12 - Responded to RFE for both(received by CSC on 2/29)

03/02/12 - NOA2 for both(received hardcopy on 3/8)

NVC: (37 days)

03/12/12 - NVC Received both

03/21/12 - NVC case number and IIN received for both & Emailed Choice of Agent for both

03/23/12 - AOS bill invoiced & paid for both

03/26/12 - AOS bill shows paid & AOS Packets mailed for both

03/27/12 - Choice of Agent accepted for wife (sent another for step-daughter via email and express mail)

03/28/12 - Choice of Agent accepted for step-daughter & IV bill invoiced & paid for wife

03/29/12 - IV bill shows paid for wife & IV bill invoiced & paid for step-daughter

03/30/12 - IV bill shows paid for step-daughter & IV Packets mailed for both

04/04/12 - IV Packets reviewed. Checklist issued for Divorce Decree for my wife. Step-daughter's was accepted and her case closed

04/10/12 - Divorce Decree accepted after supervisor review & wife's case closed

04/16/12 - Expedite requested for both cases due to NVC error

04/18/12 - Expedite request approved for both cases and sent to Santiago Embassy

Embassy: (15 days)

04/24/12 - Embassy received both cases from NVC

04/25/12 - Wife went to Embassy for document review. Interview date assigned for both cases.

04/26/12 - Medical Exam for both. Result - approved.

05/07/12 - Interview date for both. Result - approved!

05/09/12 - Received both Visas

05/16/12 - POE Atlanta
