Thanx Tango for the quick read and reply,

Yes, Hopefully by Monday I will have all the documents ready to be sent. I am just waiting for my Uncle to receive his 2011 business tax done through his accountant everything else is ready to be mailed.

I already paid the AOS just now and printed the receipt for my records.

Now as soon as it is paid, I will print the barcoded paper from the site and start organizing docs to be sent.

Wow, things are moving faster than I imagined!

You can save a pdf or print the The bar coded sheet right now actually (before it shows PAID). it'll take couple days to move from IN PROCESS TO PAID and as soon as it happen you're clear to send the AOS package. Same thing run for the IV packet after ds3032 is accepted.

And yes things are so fast comparing what ever we have to deal with back in USCIS.

Saylin,

I just received a PDF email from NVC about the false checklist asking for the DS230 as well as a bar coded sheet with different Attn. DR instead of CMR. As you know I didn't send my IV packet yet, should I use the 1st barcoded sheet that I downloaded from the website when I paid the IV fees? or the one I just received?

I got approved two weeks ago. I already paid the AOS fee... I haven't filed 2011 taxes because of the whole single/married separately etc dilemma and I was also waiting for a W2 that might have gotten lost in the mail. For 2010 I am above the requirement for the affidavit of support...but because I left my job on December 2010 and came back from my country on August 2011 I worked from September till December of 2011 and of course didn't make enough. What is the best option?

Thanks everyone!

Just thought I'd point out that isn't a dilemma. You either file as Married Jointly, or Married Separately. There is no Single option for a married person. :)

Anyone else feel free to jump in here if I'm wrong.

If your current income is not above the level you will need a joint sponsor. Since you have paid your AOS bill, you need to find one ASAP and get all their information and have them fill out the I-864.

I would just use the one from the payment portal. For that kind of checklist, you can simply ignore it.

What dilemma is there? You either file Married Filing Separately or Married Filing Jointly. While you're married to your spouse, you are legally not allowed to file single, as you are no longer single. I don't understand why so many people have a problem with this.

And if you're currently not making enough, then you have to find a joint sponsor.

What's the checklist say?

And don't worry about not writing your case number. It's not "required", just a recommendation, in case anything gets misplaced.

Thanks I understand but I had to research what to do and my husband had to send me signature etc plus I went to a few tax places where everyone said file single so I know why it can be confusing... if I take 2011 info for interview wouldnt they realize i didnt make enough and have a problem with this.

I called NVC today, just hoping. Nope, no luck, the AVR and the operator told me our case isn't there yet and to call back next week. (I'm calling back Friday)

I have a few AOS questions. (again)

My current and past incomes are not enough to to meet the poverty level for a household of six me+ 4 kids+ husband. being self-employed I kind of screwed myself a little with how much I write off on my taxes. I get a substantial amount of child support a month, does that count? And if it does how do I prove it? The ex just deposits the money in my checking account. Do I show a print out of the past 11 years of his cancelled checks?

Does the AOS work like I think it does?

My income + joint sponsor's income= x amount (waaay over poverty level)

or

My income not up to par, we'll use the joint sponsor's income which is?

Just curious is all.

Yes, it's more complicated to file taxes while the spouse is overseas without a SSN, but it has to be done, if you want to do it legally. And it's honestly not much more work. My husband and I had to do it in 2010. So, it took an extra five minutes to write up a letter saying I wanted to be treated as a resident for tax purpose, and print and sign that. And it didn't take any time at all to get a certified copy of my passport. And it took my husband an hour to file in all the boxes on the 1040EZ. And then five minutes to go to the post office to mail the package. Isn't that worth it to get your SO to the US instead of being rejected at the consulate/embassy for filing as SINGLE when you're MARRIED?! And isn't it worth the extra time so the IRS doesn't come after you for filing SINGLE when you're MARRIED?! You should NEVER return to those tax places that suggested what they did to you. It was BAD advice. They know NOTHING about having spouses living abroad.

And yes, since you didn't make enough money in 2011, that's why you need to get a joint sponsor.
