Yeah, I prefer to go with what's in black and white on the website. I never catch the agents/operators names and ID numbers, so if I followed their instructions and did something wrong, I would never know who to blame it on! At least with text, there's something relatively stable to point to if you get in some kind of trouble.

yeah, but that is the problem, in black and white on the website of irs, you are single if your spouse doesn't live with you for 6 months or more...which is the case here...

hey everyone, the tax docs wouldn't let me pass through wihtout and ITIN or SS number for my husbands, so i called irs. i filed my taxes as single, since i talked to the IRS and they said that definition of single includes if you and your husband don't live together, and haven't in the past 6 months. does nvc know this, or do i need to have my husband explain it with proof from IRS website that this is why i had to file as 'single' because my husband is not here, nor does he file taxes in the us??? PLEASE REPLY!

No online program will allow you to file married separately/jointly. That's why you have to file by PAPER. Then you put 'NRA' in the SSN section for the spouse for MFS.

You should NOT have filed as single. You are NOT single. You are legally MARRIED. IRS agents you talked to are not familiar with cases where the spouse lives abroad.

Amend your tax return ASAP.

if you are married and file single the irs and government loves you. the state department only cares about your annual gross income and depemdents for aos.this way if you file for welfare they have a record from you to get back their money. they understand filing single with spouse out of country. i did it in 1985. this is the second time i am going thru this process. this time i filed single with no dependents-because my kids only want my money but file for themselves-lol- and then to get the rest of my money back quickly, i amended my return to married to get the rest of my money from uncle sam. this i did with a w7 all the laws quoted here are to ensure a single person or seperated person does not file as married to get a bigger refund

couldn't agree more, i asked the question to see what other have done, there is an entire debate/thread, so i'll call and speak to NVC supervisor, but i won't ammend until my husband is physically here. just makes sense that way i guess. i don't know. actually don't think it reallly matters, i submitted my 2010 returns when i wasn't even married and they accepted it, i doubt that the us embassy in spain will look at that aspect of it. that is what the others have experienced, saying it doesn't make a differnce. just ammend it when the husband gets here. i get that i am not single by law, but by official irs standards, i am.

I sure wish NVC was open 24/7 so I could start pestering them as soon as I wake up, now I have to wait for them to wake up... :clock:

I'm in a terrible mood today, no skype with my husband this morning, pregnancy hormones going through the roof. I really hope the NVC operator who takes my call today got some good news or at least is polite, if not I might not be able to bite my tongue and say a few less nice words..

Hello, I received my NOA2 approval letter and trying to receive my Case Number from the NVC. One thing I am not sure about is whether to send in only the DS-3032 as an attachment by e mail and the I-864 and IV package by mail or send everything by e mail. I thank you for your advice which is invaluable.

all the laws quoted here are to ensure a single person or seperated person does not file as married to get a bigger refund

Not necessarily...a single person is actually probably entitled to a larger refund than someone who is married and filing separately, because if you file separately, you are not entitled to many tax benefits like Earned Income Credit, student loan interest deductions, child and dependent care credit, etc., which you would potentially be eligible for if you filed as single. Married and filing separately is generally disadvantageous. If you are single and try to file jointly, you would have to steal or make up a social security number or ITIN, which is clearly already fraud without the IRS creating extra regulations to prevent it. The most important line from everything I cited is that if you qualify for another filing status (married), you do not qualify as single.

yeah, but that is the problem, in black and white on the website of irs, you are single if your spouse doesn't live with you for 6 months or more...which is the case here...

Nothing that I have seen has said this, and the part of the website that you quoted earlier DOES NOT say this. What it DOES say is that if your spouse is living abroad, AND you otherwise qualify for the status of "HEAD OF HOUSEHOLD," then you may still file as head of household, but head of household is NOT the same as "single." Head of household filing requires that you are not married (never married, divorced, widowed, whatever), but they make an exception for people whose spouses live abroad. But I repeat, head of household is not the same as single; those are two separate boxes to check on the 1040. The website is clear that you cannot file as single if you meet qualifications of another filing status, which married people do. You can do what you want, but personally I won't be convinced that a married person with a spouse overseas is allowed to file as SINGLE until I see an actual quote from the IRS website saying so. Nothing quoted so far here and in the tax threads has said that.

:ot2:
