I think that shouldn't be a problem. That's the one filing status that it's okay to be considered "unmarried" for when your spouse is a nonresident.

HoH is fine. MFS or MFJ is better, but HoH is legal whereas filing single is not.

OHH Thank God i feel relieve now coz i thought you would be mad to hear that i didnt ammend the tax.SO if now its fine,can i ammend it when i come to states as MFJ?What about his dependents?

Nope, you're good No need to amend it if you don't want to.

As far as I know, you can still list dependents on the 1040 when filing MFJ. But I don't really know as neither my husband or I have dependents

i have another serious problem with my marriage certificate where my mother's name is incorrect. but USCIS didnt say me anything about it.I Already sent the application to correct it to the marriage registration office and asked for expedite.I will send the old scanned one to NVC and bring the correct one to Interview.what do you say?

Sounds good NVC might not even notice the error. Is it just a small, barely noticeable mistake?

Yea is very small.you cant even see the names properly.IT was n insted of m.

No, my husband filed Married Filing Separately. With this option, you don't need an SSN or ITIN for the foreign spouse, you just write NRA (non-resident alien) in the SSN field.

This is Exactly how I filed at the IRS Office, it 100% True if you don't want a problem at your Visa interview!!

So... my husband has bet me that I can't hold back from calling NVC until Monday to find out if we've been assigned an interview date. I expect that this challenge is meant to encourage me not to obsess about it, but now I've resorted to checking this forum every five minutes instead, hoping another UK applicant with a case complete date near mine has gotten an interview so that I have an excuse to be optimistic and call NVC.

This whole immigration process really doesn't sit well with my natural OCD-like tendencies!

I filed my 2011 taxes as MFJ. The whole process took 3 weeks from the time I handed in the W-7 and paper return at the local IRS office. It was a bigger refund than MFS and my 2011 tax return shows as married with my wife listed on it. Definitely worth the extra work in my opinion. I just requested my 2011 tax transcript so we will have it at the interview in case they ask for it.

As for NVC related info my wife's IV was invoiced today so I paid it. Still waiting for my step-daughter to get her IV invoice, hoping for tomorrow. With some luck I can submit the DS-230 application and supporting documents by Friday or Saturday.

I guess this is the "fun" part of the process when there is something happening almost every day.

Saylin whats wrong with EP online forms? Ive submitted DS 261 form a week ago but still getting no invoice for IV.I email DS 3032 to NVC today.See what happens.

Neela, Sheeshkabelle and I are both still waiting on our first invoices. Nigel told her yesterday that there's a system error and ep is taking longer to put in the system as of Wednesday last week. (However, Nikki told me there's no problem, they're just not ready, blah blah...I'm going to guess she's wrong on this one).
