Hehe, yay, I'm Bus Driver Saylin now :D

Yeah, since you're so close to the 2 year anniversary, it'd be worth the extra month waiting just so you can get an IR-1 stamp. This will save you almost $600 (and a lot of headache). Just make sure the officer at POE gives you the correct stamp and make sure all the paperwork is fixed so you get a 10 year green card instead of the conditional 2 year one. I've seen a few people here that should have gotten an IR-1 stamp/10 year green card, but didn't.

Oh yes. I'll make sure. I'm even going to ask nicely during his interview if they can put some kind of note in his sealed package that he could be eligible for an IR-1 after June 12, 2012...

We will do POE at the Pembina/Emerson crossing from Manitoba in to North Dakota, I'm not sure if they get too many CR/IR-1 visa activations.I printed out the page from USCIS and DoS about the IR-1 visa. I'll again, nicely, ask the CBP officer for his IR-1. I've trained hubby to say IR-1, IR-1 in case the CBP officer thinks I'm too pushy and kicks me out lol.

I doubt the consulate can put a note, but it's definitely worth a shot!

It doesn't matter where you fly to, if you go through the Winnipeg airport, that WILL be your POE as it's a preclearance location.

And there's no direct flights to your destination from Winnipeg?

Actually, I don't so much know about that - my preclearance area will be either winnipeg international or toronto international. When I've flown to Trav's before, if I go through Toronto I clear customs there and not here, and it's a much easier POE...but I highly prefer stopping in Minneapolis.

And don't I wish there were direct flights to Charlotte from Winnipeg?! LOL...

It doesn't matter where you fly to, if you go through the Winnipeg airport, that WILL be your POE as it's a preclearance location.

And there's no direct flights to your destination from Winnipeg?

HAHAHAHA no! Shell and I live in podunk TN/VA.. we're actually an hour apart from each other. All we have here are small (very small) regional airports. The two closest international airports to us are Charlotte, NC or Nashville, TN: both four hours away.

I printed out the exact code from their own USCIS handbook:

Admission of conditonal permanent residents

Section B: (b) Correction of endorsement on immigrant visa . If the alien is subject to the provisions of section 216 of the Act, but the classification endorsed on the immigrant visa does not so indicate, the endorsement shall be corrected and the alien shall be admitted as a lawful permanent resident on a conditional basis, if otherwise admissible. Conversely, if the alien is not subject to the provisions of section 216 of the Act, but the visa classification endorsed on the immigrant visa indicates that the alien is subject thereto (e.g., if the second anniversary of the marriage upon which the immigrant visa is based occurred after the issuance of the visa and prior to the alien's application for admission) the endorsement on the visa shall be corrected and the alien shall be admitted as a lawful permanent resident without conditions, if otherwise admissible.

Oh, never mind, I get my mistake. Since you're flying from Winnipeg to Toronto, it's just a domestic flight; you're not flying to the US yet. D'oh headbonk.gif I think it's time I get to bed, my brain has clearly stopped functioning...

And I LOVE Minneapolis airport. Whenever I flew here to South Dakota, that was the stop right before the tiny airport in my husband's town. I love love love their moving sidewalks, and the restaurant Sbarro's there. Om nom nom :D I haven't flown since August 2010, I kinda miss it :(

Keep in mind, not all border officers are competent :P I've seen it happen a lot where the beneficiary should have gotten an IR-1 stamp, but didn't, or they did, and then USCIS was stupid and sent them a conditional green card headbonk.gif

If they mess it up, I'll whack them with their own handbook! I figured I'd come prepared. I'll be nice about it.. I promise! I would hate to get this far then cause an international incident!

Don't hurt your noggin with that hammer! I had that thought before too, and was SO confused the first time I went through Toronto! But then again, that airport messes with my head...so badly...

I love Minneapolis too, and Trav loves it even more! He doesnt' even take the tram anymore and requests a longer layover so he can just walk between terminals. It's a really nicely laid out airport and the walkways are pretty nifty :) LOL...what's a Sbarro??
