Timeline

We were one of the cases they were incompetent with.. as in they misplacedlost our file and it appeared again after my Congressman contacted them the second time.

It took 8 1/2 months for our approval.

Wow that is terrible! Our journey has been very short since I'm living overseas with my husband. I don't know how all of you who waited 6+ months at USCIS didn't go crazy! But hey, we are almost done now!! :dance:

11-19-2011 Married in Paraguay

01-09-2012 NOA1 email

01-19-2012 NOA2 email (USC living abroad with spouse)

NVC - 33 days

02-08-2012 Case number and IIN assigned (9 days after NVC received)

03-12-2012 Case completed

04-06-2012 Received interview letter in e-mail (25 days after case complete)

04-10-2012 Medical in Asuncion

04-30-2012 Interview-APPROVED

05-02-2012 Visa available for pickup

USA

05-10-2012 POE-Bahamas

05-25-2012 Welcome Letter received

On the instructions of the form I-864W says:"Intending immigrant is a child who will become a U.S.citizen immediately upon entry under the Child

Citizenship Act of 2000 (CCA)". Under the CCA, some

children become U.S. citizens immediately upon admission

to the United States or adjustment of status to that of a

lawful permanent resident. For this classification to apply:

1.)At least one parent of the child is a U.S. citizen;

2.)The child is under 18 years of age at the time of

admission or adjustment of status.

3.)The child is residing permanently in the United States in

the legal and physical custody of the U.S. parent.

I don`t understand the part 3.

The question is:

my son has a U.S.citizen parent (who has lived all his life in U.S.) and my son is under 18 years of age (he is 4 years), but my son is living with me in venezuela( he is intending inmigrant with me to the U.S) , Can my husband fill the form I-864W for our son yet? or I-864? thanks in advance!

09-19-11: touched

09-23-11: got I-797c hard copy of Noa1

03-14-12: Noa 2 (Approved)

Is your husband the biological father of the child?
