We are in the same situation. My dad is my joint sponsor and I also used his address for the US address where we are intending to live. We considered the I-864a for awhile too but finally went with the I-864 and we had no problems at NVC. Good luck!

Thanks a million for the help, Amanda! Can I ask if you went ahead and sent in a copy of your birth certificate to prove your relationship to your father? I know I have to prove my dad is a USC, and will get him to send in a copy of his birth certificate, but I am wondering if I need to send mine as well.

Steph u r never gonna die...I was about to txt you. I was in the usembassy at DR website n noticed that the April interview list is not out yet, and supposably they put it out the 2nd week of the month prior. We are by the 3rd week now, this is looking too much like if they have not filled up all april spaces...oh ohhhh

I'd say everyone at the same time. NVC and DOS will able to tell you if your interview is scheduled at the same time, and since DOS and the embassies have a shared system for immigrant visas, they should all be able to know it.

But you don't call the embassy to learn your interview, there's just no way people answering the phone will be able/willing to tell you. You call NVC, DOS if you want a different experience, or you wait for the email.

Hi all,

I'm working on completing my AOS for my husband, and have a question for which I can't find an answer.

I'll be returning from abroad, and on the I-864, for mailing address, I used my parent's address in the USA. For place of residence, I used my address abroad.

As I'll be returning from abroad, I am using my Dad as a joint sponsor, and having him fill out the I-864, instead of the I-864A. We are not members of the same household, but I have used this address on the I-130 for the 'address you intend to live at in the USA.'

I think I might be worrying too much, but will this cause the NVC to think my Dad should be filling out the I-864A?

I'm over-analyzing, aren't I? Or not?

Joint sponsors generally fill the I-864 (whether household members are not). Generally, the I-864A is for the spouses of joint sponsors. So, for example: the petitioner files an I-864, the petitioner's joint sponsor (who is his father) files an I-864, and the joint sponsor's wife (who is contributing income) files an I-864A.

In your case, I'd suggest your dad file the I-864, the same as you.

I'd definitely suggest you send a copy of your birth certificate. I've seen people get checklists for not proving their relationship to their joint sponsors when they're household members. I know you're not currently household members, but you used their address on some of the forms and NVC gets weird ideas sometimes. Wouldn't you rather be safe than sorry?

If you gave over the petitioner's and beneficiary's email addresses to an operator, ALL correspondence is received through email, including the interview letter.

Nope, she doesn't need to fill out the I-864A. She'd only have to fill it out if she's contributing her income as another sponsor. But she's not in your case, so she doesn't have to do anything no0pb.gif

Yes, I sent a copy of my birth certificate for proof of relationship between my father and I. And then he sent a copy of the biographic data page of his passport or proof of US citizenship. His birth certificate would also work for that part.

I'm submitting the only one I have - lists our names and birth places, date and place of wedding, and when it was registered as legal (as well as the registry number). it's on official certificate paper, with a seal.

Does it has your signature and your husband's signature on it?

If you provide a photocopy of your tax return(s), you must include a copy of each and every FormW-2 and Form 1099 that relates to your return(s). Do not include copies of these Forms if you provide an IRS transcript of your return(s) rather than a photocopy.

and then at the end of the instructions it says:

The following items must be submitted with Form I-864:

For ALL sponsors:

A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years , pay stub(s) from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

so what do we need now? is it ok if we just include the tax transcripts of the past 3 years or do we have to get my husbands tax returns, w2, pay stubs, letter from his employer?

It's alright to include just the tax transcripts. It's very much preferred by NVC over the tax returns and W2s.

Pay stubs and employment letters are optional.

If you include tax transcripts then you do not need to include W2s/1099s. The instructions say to provide either/or. Pay stubs and an employment letter are optional, I think most people include them.
